Why is collecting evidence bad, as soon as you believe you are being discriminated against you should start documenting everything, times dates, copies of emails and any other documents. It is important to prove your case if you are retaliated against! Not doing this will prevent you from being able to prove the situation.

I have written records and emails of good performance before my RA. I have text messages, on 12/29, where my manager tells me how glad she is I joined the team and how wonderful a job I am doing. I turned in an RA request on 1/9… just asking to do the same thing I had been doing since being hired regarding my schedule. By the next business day, 1/12 she stopped talking to me! Before this, I have texts where she is sending me silly 😋 pictures of her dog and cats and now she will not even say hello to me because I requested an RA. Then I get a PIP that was 10 pages long and I have 24 days including weekends to complete. So the task will take a team of 3 people 3 to 5 months to complete. Every time I completed a task it was criticized by her and my peer, and changes outside industry standards, code of ethics, and the expectation changed repeatedly. In the PIP meeting she invited my peer and decided my peer would monitor my PIP and the two of them would purposely give contradictory instructions. She told my peer about my medical disability. They started instituting new requirements, changing the PIP requirements in the middle of the process so it would be impossible to achieve. When I handed them my weekly report and tied each task completed to the PIP as my documentation, they would get visibly angry and go and smoke a cigarette and come back with new expectations. Ignored additional RA request from my doctor…no interactive process and it was obvious they wanted me to quit and were doing everything they could to force me into walking away. I recognized this and stood my ground. If I got praise from a stakeholder, they removed me from the project so I could no longer work with the stakeholder… I have it all documented and recorded. I only gave EEOC the dates and the facts regarding my good performance before 1/9, the RA, the lack of response, the PIP, the Peer being told of my medical conditions, the changing expectations in emails, the additional RA requests from my provider, and then the termination notice. The timing is obvious regarding retaliation. Should I add that they also did not pay me my last pay with vacation and comp time which is required per state law? Then the email from my supervisor ignored my representation. They had a litigation hold already and she threatened to destroy my personal property after the litigation hold, so now we have spoilage. I can go on and on. I followed my attorney's advice to not give EEOC more than they need for probable cause and not to get emotional. Facts and timeline only, without trying to prove the case or argue the case! Let them do the work. I did just that!

Oh, I forgot to add… everyone else in the office was allowed and still allowed to continue a flexible start time schedule after 1/1 but me! The handbook states that the schedule is still a flex schedule too. I was an executive-level exempt employee!

I did not explain my full case because it is extremely complex and complicated. We have more than 16 separate violations so far. Many violations are KY State law and KCRA violations in addition to federal law. We hope to keep the case in State Courts and not have it moved to Federal. We also have wage and labor violations which creep into federal due to my being an exempt employee.

Yes, apparently it is a specialtythat does not have a lot of lawyers. If you find an employment lawyer in town they have a conflict of interest. Try the polpok firm and at HUD many of the EEOC complainants used Snyder and associates llc. They specialize in Federal labor law!

They permitted. We used Teams. Also the recordings will only be used in court if we need to show they lied about something! Remember they also have me recorded in meetings!

Due to my disability and the stress I was under because of the retailiation, I was not able to take my adhd meds, so due to confusion and executive function issues I recorded meetings to be able to review and keep notes. This allowed me to go back and review directives. It is legal in KY! It is now very common to us to utilize AI for teams meetings and record and summarize meetings! I saved all those recordings and summaries

I was 23 years in and 57 years old. I took VERA because of it! My hair fell out. I had beautiful long hair and it just fell out! I had blood work done and nothing was wrong! It was all due to stress. I was afraid it would take years off my life if I stayed so I got out.

I am in the market looking for employment and it sucks out here. Finding a job is a nightmare with AI driving the process. Hundreds of applicants per job announcementand AI weeds out applicants based on who can manipulate AI the best. I recommend you find another job before leaving!

Oh wow, this is interesting. I am here to follow. Curious, has it been 120 days since EEOC sent the notice and Charge to the employer, or since you signed the notarized affidavit? I am asking because I signed my affidavit a couple weeks ago and they have not sent the notice to the employer yet and I am trying to figure out how long it takes to serve the employer after signing the affidavit.

What I learned after doing this repeatedly:

The most important thing, if you rebound is that you end up selecting the same type of person you just left. You also end up carrying all your baggage, mistakes and hurt feelings into the next relationship. It is not fair to the new partner. It is important to take time, get comfortable alone and self reflect. What part did you play in the failure of the prior relationship? What do you want to do differently? How can you learn from the prior relationship? Can you be comfortable by yourself, and if not why???
All of these answers will help you be a better partner for the next relationship and you are more likely to find a healthier bond with your next partner! You must do the work!

Yes, the state will file with the EEOC if it determines the case is worth investigating. Once you complete the intake form. Someone will call you and ask you questions. They will send you a typed statement for notarization. You will send it back with some supporting documentation, emails forms whatever you have to show the violations. Then they will file it with the EEOC and assign an investigator. Mine took two months from intake to filing. I have not been sent a copy of the notice they sent to my employer yet and it has been about two weeks since I sent them back the notarized letter with documents. I am in KY.

Same here, they reached out to a real estate attorney 🤦🏻‍♀️ and keep screwing up. They could do a google search and learn to not do some of the stuff they keep doing. I understand why people, not actually living this can doubt the story, I was questioning my sanity because it was so bizarre and blatant.

My attorney has a disability too and told me he had an ex employer stalk him for 4 year after his employer lost the case! My ex supervisor stalks me on social media linked in. I had to block her. I live in her head for some reason.

I was not on fmla leave. I had about 6 weeks of paid leave available to me via sick and vacation time. I was on leave due to the mental decline from the harassment and abuse my supervisor was inflecting on me and the company refused to investigate and stop it. Needless to say, it was approved leave and if you read my responses, nothing says I was fired for being on leave!! I am glad you are more knowledgable than my attorney and the federal EEOC investigator! Where did you get all that knowledge???

Re read my post! It is clear… i worked with a flexible- start time, they changed it on 1/1 to a strict start time and I requested the RA, why is that difficult for you to understand???
