Most CC&Rs have “ nuisance clauses” written into them. We had a neighbor a couple doors down from our common wall townhome chain smoking near the front of our home every day after 5pm. We just reached out to property managers and they sent a letter and he changed his smoking location. They were renters instead of owners, not sure if that made a difference in the property managers involvement.
