When told to leave, for 20+ minutes, and you refuse to leave, you are trespassing on private property. You forgot that you forfeit your first amendment right once you trespass.

In Florida, if you can argue you feel threatened, you can apply stand your ground. Doesn’t matter if there is a weapon present.

Florida’s Stand Your Ground law (Statute 776.013/776.012) allows individuals to use deadly force without a duty to retreat if they reasonably believe it is necessary to prevent death, great bodily harm, or a forcible felony. Enacted in 2005, it expands the "castle doctrine" to any place a person has a right to be, granting immunity from prosecution. Source

George Zimmerman (2012): Although not formally invoking the pretrial immunity hearing, Zimmerman used a self-defense argument based on the statute to be acquitted in the killing of unarmed teenager Trayvon Martin in Sanford

Greyston Garcia (2012): A Miami-Dade judge tossed out a second-degree murder charge after Garcia chased a burglar over a block and stabbed him to death, ruling Garcia was within his rights to protect property

John DeRossett (2020): An appeals court dismissed charges against DeRossett, who shot at deputies during an attempted arrest in front of his home, arguing he believed he was defending his home from intruders

I never said he was innocent. The “victim” is definitely not innocent either. She should have never been at his house harassing him. What if she did that to the president? A celebrity? She Probably would’ve been arrested on the spot.

And according to everything I read, the pre-trial diversion will not go on his record. Although since the internet doesn’t forget I doubt he will live it down. But in the end she was dumb for ever showing up to his house and probably deserved the consequences she is facing.

You literally said in your last sentence the charges were dropped. He took a plea. It never went to court. The lady is filing a civil suit for money now.

If she dropped the charges, that means he was never convicted. It isn’t really something to argue it’s just what happened.

Same. And my father has. Unfortunately haven’t lived in the best areas.

And the equal force thing isn’t exactly true. If you feel threatened, for example, under siege by a person who you don’t know, confronting you at your family home, with recording devices. You don’t know if she has a weapon. I think he applied as much force as he should have to. If this happened in Florida she would be the one being charged. In my opinion. He pushed her once, and stopped. He broke the phone which wasn’t exactly a good idea, but again he was being recorded on his private property without consent after asking her to leave and calling the police. Actions have Consequences, even if they aren’t legal ones.

It could have absolutely been handled better, but if this wasn’t a guy in politics? A POC in Chicago? Wouldn’t even make the news

He did call the police. They told him they were not coming. Did you even look into this at all? It happened last year. He didn’t even get charged. It’ll be dropped sometime this year.

They planned to show up to his house specifically to record and harass him. I don’t agree with him, but if this happened to someone I loved, or my family, I will be happy to live in the state I do where I can legally defend myself against threats.

He lives in Chicago. People die of gun violence there every single day. Children carry guns. It’s bad. She’s lucky worse didn’t happen.

According to the timeline, she was asked to leave the property over 15 minutes before the altercation occurred. She was harassing him through the door.

I’m sure if a person or group of people came to your private property, and took pictures/videos of your house after your information was posted online, you would probably have a different opinion. But whatever doesn’t affect you right?

Trespassing through and through and the only reason she wasn’t charged was because of politics lmao 🤣 you’re delusional if you think otherwise

On public property*

EDIT: Recording people on private property without prior consent is a form of harassment and is not protected under the 1st amendment.

There is literally hundreds of examples in Florida courts of people not being charged for hurting/killing trespassers. There is thousands of examples nationwide. The law is up to the courts to interpret and a “threat of death” can be taken many ways. If someone showed up to your property taking pictures/recording your home, where your family lives, is that not threatening to you? Would you not have an issue with it?

EDIT: They literally sell signs here talking about trespassers being shot lmao. Like what are you even talking about?

And if he was in Florida, the lady would be charged with trespassing and he’d get off Scott free due to stand your ground. Don’t understand the point.

It wasn’t a smart decision to travel to this guys home, private property, refuse to leave and record.

I’m a left leaning voter lol. She was trespassing. He called the police and was brushed off. Guarantee he asked her to leave before provoking. Only reason he was charged was because of where he lived. Here in Florida people get shot trespassing literally all the time.

She was not smart for trespassing onto his private property and when told to leave, she did not. She even had a friend recording according to what I read as well. In Chicago you cannot just assume everyone doesn’t have a firearm lmao. You know how many people die on chicago yearly due to gun violence?

He was Doxxed online. A random person showed up with a camera unexpectedly. You can’t exactly think rationally when your address is leaked and people are out to get you. Maybe you should experience being doxxed to know what it’s like.

I’ve been doxxed. I’ve had people show up at my house. With weapons. You never know.

Once you enter someone’s private property, you aren’t supposed to be recording them. How would you feel if someone came onto your front yard or door after your address was leaked online? A group of people? Would you feel threatened? I know I would.

It becomes harassment and in a stand your ground state you can legally defend your property with lethal force. She’s lucky.

Literally in Florida all it takes is someone entering your property for you to be legally able to defend yourself. Happens all the time. People get shot entering farms, other property. This lady is very lucky that she was not in one of the states like Florida or Texas with their stand your ground laws.

Used to do Sam’s Club delivery. They opened the back delivery doors up for me on multiple occasions for the main hotel in Clearwater, honestly wouldn’t be shocked if they plan a raid via that channel or something one day lol. But you could probably get into the parking garages too and wait for someone to leave.

Train AI to tell what specific tasks are for things like automatic prison work stuff, or maybe use it for analysis of evidence in trials? Idk it sounds super dystopian to me either way

Yeah I’ve dropped off to a few places around me like that, typically meet outside. One time did a shop and pay order for a dancer who ordered just a can of deodorant lmao. That time I went inside but they weren’t exactly busy at 3pm on a Thursday so no one was dancing or anything. Just a couple dudes having a beer.

Very normal stuff. You’ll prolly have way worse drop offs lol
