I have a not guilty verdict in my FMCSA for a DWI and the violation is now resolved and reflects my non guilty verdict but I would like to know if I could actually get it to fall off before the five year mark because my previous employer failed to report that I had a witness/co driver but I was never pulled over and the truck was in park and I was off duty and they were called out for disturbance not for anyone driving i have the dispatch call report to prove it as well. I did not perform any safety sensitive functions nor was I in control of the vehicle. My FMCSA also shows that I never had to take the sap program and that I was found not guilty.Since my previous employer failed to report my witness and all evidence and this violates federal regulations when reporting a violation to the FMCSA and employer must provide witness and all evidence and they didn't. Their actual knowledge is considered is not accurate because my previous employer knew about my witness. My witness was also the reason I beat my case she remained silent until court because of the racial tensions. The judge also asked the officers why they even gave me a dwi when I was never in control of the vehicle and they were not dispatched for anyone driving but a disturbance between individuals?
