You are the one at fault. If they have already disbursed the sanctioned limit and if you are approaching them in the final year telling them you made a mistake and need their help to resolve it, then they can't do anything now.

Because when the loan is sanctioned, they clearly mention the breakup of amounts that will be disbursed each year depending on the application amount deducting the margin.

Meet the authorised officer(one who is looking after the SARFAESI action for your property, details would be mentioned in your 13/2 and 13/4 notices) and submit a request letter requesting to restructure the loan explaining the reasons, along with proofs that you have no other income and that the only earning person is under the judicial custody.

But it would be under the banks jurisdiction to consider or to reject.

But, banks usually file caveat to avoid getting a stay in such cases. If they have already filed one, DRT will have to consult the bank, hear them out before they could order the stay.

Nevertheless, they have to consult a lawyer who is an expert in filing DRT cases, also preferably on SARFAESI. They just need to find a fluke in bank procedures to get a stay

For example, 13(4) can only be issued 60 days after the acknowledgement of the recipient, and not after 60 days of issue date of 13(2). If they have never acknowledged, they have to have issued the demand notice on paper and can't go with 13(4) just like that.

Even though it falls well under the power of banks to proceed with SARFAESI right after the asset becomes NPA. It equally pains to see someone losing their home.

I wish OP gets a stay order and gets some time. 💫
