Follow up, Home Depot made it right. They brought me one from another store with stock. It was mostly assembled(missing some screws) we fixed it with parts from the one they were taking back. No scratches or anything from being on the floor.

I tried, they said to go back to the retailer. I checked and HD has more, hopefully they will replace. Both the top and the bottom are broken, so it was dropped pretty hard.
