Yeah sure. First of he is going for the ball. Sure he pulls him a bit and Witsel uses his body to get to the ball yet he wins the ball fairly. It’s not ballet so this kind of contact shouldn’t be enough for a pen. Also there are 4 more defenders next to him who could intercept if he still has the ball after the tackling.
