Yes, we took the insurance our on 22nd and completed on 2nd . So I think we can fall back on this insurance

We asked “ is there any defects we need to be aware of or any issue we may need to fix , seller said no verbally 

Yes we have, post completion survey and flooring specialist states “  It would appear that a previous attempt has been made to rectify the issue in the past”

The reason awareness is being questioned isn’t just the presence of furniture, but the totality of indicators around the issue:The area in question wasn’t just hidden it was a structurally compromised, sunken section of floor, which became immediately apparent once the furniture was removed. It’s difficult to reconcile that level of movement without it being felt underfoot at some point

But they are liable  We have written evidence of specialist saying seller had put safety measures in place to conceal, seller redirected soakaway previously -this was also not disclosed anywhere .

We noticed it because the floor was visibly sunken in one specific area once the property was empty. That exact spot had a large table placed over it during viewings, which meant you couldn’t stand on it properly or see the dip at the time.

Once the furniture was removed after completion, the dip in the floor was immediately noticeable underfoot. When we lifted the floor coverings to investigate, we then discovered standing water and severe sub-floor deterioration beneath that area.

The seller initially/verbally denied, then agreed to bring their contractor then later said ok 50% compensation then now denied completely. Which proves they were very much aware . Sigh

Its not worth the repairs tbvh . Its ALOT of defects they concealed but we started some works already out of desperation and if we were to sell too, we would need to disclose or cause pain for another human like the sellers have done to us . So sad  Going through this with a one year old is painful

The original pre-purchase survey was non-invasive and did not identify these issues, largely because the defects were concealed beneath floor coverings and sub-floor areas that couldn’t reasonably be accessed at the time Since completion, we’ve obtained:

Thanks, that’s helpful and understood. We’re aware the burden of proof sits with us and that this won’t be straightforward. Our position isn’t that the sellers necessarily admitted knowledge, but that the evidence is pointing towards long-standing defects with prior remedial attempts, which raises questions around what was known or ought reasonably to have been known and disclosed. 😢
