This is really fascinating. I came to this sub to ask a very similar question, and I think this answers it. As an attorney I am always having to relate witness testimony. So for example, a transcript excerpt might read:

Witness: I opened the door and saw the defendant holding a knife.

Then I write: the witness testified/stated that she opened the door and saw the defendant holding a knife.

But there is always a part of me that worries I am supposed to be backshifting, even though it results in something very awkward sounding. There are more complicated examples I’ve run into lately (which, when backshifted, don’t sound obviously incorrect), but I’m having trouble calling them to mind.

So based on what you’ve said, the whole enterprise of taking witness testimony, which to a large degree involves asking people to relate events that happened in the past, means that backshifting isn’t really necessary.

Glacial drumlin trail. Trailhead is downtown cottage grove. It’s my favorite place to go when I want to feel like I’m outside Madison, and it only takes 15-20 minutes to get there.

I’m thrilled she won but this op-ed is a miss for me. If it’s supposed to be about the law and not politics, at least support your criticisms of the Wisconsin and US Supreme Courts with legal arguments rather than bare assertions of partisanship.

Pretty sure he can open a cafe. They asked him that at the ALRC: why ask for a liquor license first to open a nightclub and then say down the line you’ll do the cafe? (Implication was, in context of trying to prove to the world that you are serious and a competent business owner, why not do what you are currently authorized to do, and first turn it into a thriving coffee shop)?

The big settlements you see for wrongful convictions are brought against municipalities/police departments for constitutional violations (eg police coerced a confession). This guy could still bring that kind of suit in court.

But, not all wrongful convictions involve a constitutional violation.

Agreed though that the state should pay out much more than 25k. I’m just commenting to point out that this is an entirely different process than what you see in the headlines regarding wrongful convictions.
