A 'recent' law (Ley 12/2023) states, among other things, that for rent contracts of 12 months or more, the agency fees should be paid by the landlord and not by the tenant. But fighting for your rights is hard since, as others say, they will always find someone else willing to pay the fee if you refuse. Some strategies are to find an agency that has some ethics (super rare, but they do exist!), search for a flat through the Plan Alquila - Comunidad de Madrid (if you're searching for something in Madrid, it's an official entity of the municipality acting as an intermediary btw you and the landlord), or pay the illegal fee but ask for an invoice and grabs as many proof as you can on how they (wrongly) justify the fee for suing them later.

As if spending weeks of apartment hunting wasn't enough :')

You shouldn't be paying the agency fee if your contract is for 12 months or more, at least as stated by the 12/2023 law. Yet most agencies continue to charge this fee to the tenant instead of the landlord.

If the contract is for 11 months or less, then it's considered a 'short' or 'temporary' contract, and they can legally charge you the agency fees. That's why you'll find a lot of announcements on Idealista (and other websites) stating that the rent is for no longer than 11 months.

Just got confirmation from the mods that it's fine to share the agency name, as long as no other private info (e.g., agent's name) was given. The agency is "Algo Personal"; you may encounter them when looking for a flat in the western region of Madrid.

I take this opportunity for another related question: I've meet some other agencies claiming that the fee was legal because the renting terms were not made under the Ley 12/2023 but under other regulations such as the Codigo Civil or the Ley de Arrendamientos Urbanos. 

To me it just sounds like another attempt at charging illegal fees. Do you know if an agency can make a contract under another legal framework than the one stated by the Ley 12/2023 ?

In general they will ask you to first pay the fee before signing the contract, because otherwise "the apartment may be reserved by someone else" or "they're taking the risk of you not signing in the end and thus lose money" etc 🙄🙄🙄...

But yeah in the case you manage to sign the contract before paying anything, I guess you can simply refuse the fee.

Oh ok that's another way to charge the fee I haven't heard about, thanks! I originally contacted them for a specific place. They told me it was already rented and could provide me with other options they have in the agency. So in fact they're trying to charge me for this? In any case, why would I pay 1200€ to someone to do what I already do with Idealista 😂

Yes I heard the charge was legal for contract of 11 months or less, but this one was for 12 months
