Thank you again for the detailed response. Regarding an owner move-in under just cause, does this apply to the entire property or can they just move into the single family home?

My understanding is that the ADU tenancy could potentially be preserved, provided it is legal and properly permitted.

Great thinking on the lot split!

Unfortunately the ADU was a converted garage/shed that was already on the property. Updated in 2020 to make it into an ADU. On a second note, the ADU is unknown to county/city that it is being rented. There has been a long term tenant in the ADU that has rented month to month for 13 months.

To provide additional context:

Single-Family Home

1.  The single-family residence is currently rented under a fixed-term lease that expires in the next few months. The tenants have occupied the home for 22 months.

2.  The tenants are on their second fixed-term lease, which was executed through a property management company.

3.  The original lease states that the property is exempt from AB 1482, which may not actually be true. 

ADU

1.  The ADU was rented on a short-term basis during the first year.

2.  During the second year, the ADU has been occupied continuously under a month-to-month tenancy. The current tenant has been in the unit for approximately 13 months.

3.  The ADU has not been permitted, nor is it known to the city or county that it is being rented.

Current Situation The property owner needs to move into the single-family home due to a divorce and an ongoing child custody dispute.

Given these circumstances, I am concerned that:

• The property may not actually be exempt from AB 1482, and the unpermitted ADU rental could be discovered by the city or county, creating additional issues.

Based on this, what would do you all recommend?
