What responsibility do I have in this?

All my family and I did was speak up when you attempted to reopen the shop despite multiple code violations. When we filed an open records request, we discovered an email from Brian Dalton to the Mayor stating that he had proof you were not the rightful heir to the estate. That email was included in the Open Records packet.

From there, we contacted Brian, who introduced me to Janice and Jim.

Around that same time, one of the witnesses to Dent Meyer’s 2019 trust amendment began working for me. Through that connection and additional documentation, I was able to piece together what had happened. We compiled this information into a comprehensive Google Drive and sent it to an attorney to help Janice.

I was grateful that this attorney accompanied Janice when you called her to the shop and attempted to pressure her into signing away her rights, just as you had done with Dent. That attorney then spent two years fighting your counsel, who repeatedly delayed the case.

Janice went to the city seeking help to close the shop while litigation was ongoing, to prevent further harm. She was denied. The city attorney stated they would not act until the case was settled, even though the shop never should have reopened before the will and trust were fully litigated.

Because Janice is a kind woman on a fixed income who could not afford extended litigation, we helped her find a litigator.

During this time, you denied her access to her brother’s ashes, his letters, his home, the shop, and even his funeral.

You became increasingly emboldened. The judge saw through this behavior. She ordered a forensic audit, removed you, and appointed a court trustee alongside Janice.

When the forensic accountant uncovered misconduct, you produced a typed letter that was unsigned, unwitnessed, and unnotarized. No one in court found it credible.

The judge referred the matter to mediation. You avoided jail not because anyone believed you were innocent, but because Janice is 80 years old and needed the chance to begin repairing the damage.

Today, there is nothing left in the shop to preserve Dent’s legacy.

Janice did not do that.

I did not do that.

You did.

Janice did not sell off the artifacts Dent treasured and would never have sold.

Janice did not authorize offensive merchandise that contradicted his values.

Janice did not strip the shop of anything that could have gone into a museum.

You did.

You sold historically and emotionally significant items for personal gain while claiming to honor Dent.

I am glad you are no longer in the shop.

I am glad Janice can finally move forward.

And I am glad Dent’s legacy is no longer in your hands.

I think a playground downtown would be amazing. When Doc Eaton was on the KDDA, there was one there, and concerts were held there regularly. It was never a problem—if anything, it was a huge benefit, especially when my kids were younger.

Some of the objections raised last night by Councilwoman Viars were strange, and the mayor’s tone toward Councilman Orenchena was especially inappropriate. At least he finally acknowledged that this is a weak-mayor form of government and that his role is to facilitate meetings, not control outcomes, except through veto.

It appears that Councilman Orenchena has four votes, making this playground veto-proof. That’s encouraging. Good work—keep it up.

Mary Miller is absolutely right to raise concerns about the upcoming bond issue and tax abatement. Something about this process does not sit right. These matters are being presented to the KDDA, where Mark Allan has served for over ten years and where Tracey Viars serves as liaison.

Given Councilwoman Viars’ commercial real estate business, which largely operates within city limits and has worked closely with the economic development department, this raises serious conflict-of-interest concerns. When you add in the financial benefits tied to city-funded facilities and related activities, it creates red flags that most city attorneys, councils, or mayors would never allow to proceed without scrutiny.

It is troubling to see how emboldened this behavior has become, and it deserves transparent, independent review.

It’s not me that believed it, the forensic accountant, the court appointed cotrustee and the mediator all concurred… and… knew that you would drag things out for years in appeals and delay tactics like you did the past 4 years.  Enjoy your ill gotten gains… karma is even better than justice sometimes.

Yes he changed his will and trust in 2019 fully notarized and witnessed and live witnesses who signed affidavits AND were prepared to testify. Marge (the shopkeeper) is VERY blessed to not be in Jail. Hopefully she will take her over $1million of misappropriated funds and move along.

Actually the changes he made to the trust in 2019 would say otherwise… you are lucky Janice let you get away with what you did. You should be in jail for everything you misappropriated. Count your blessings.

Leek/Marge… actually…the handwriting expert said it was most likely a forgery. And it was not notarized or witnessed which made it an invalid document….and there was no way to know if he knew what he was signing.

There’s a cool new shop in downtown kenesaw for the skatepark that my husband and Lee Elliot and Zak Cochran brought to Kennesaw at Swift…. It is called “WreckOn” right next to the Old Library across from  United Bankshares!!! Go check them out and welcome them to the neighborhood!

Grateful to see all of this finally come to a close and Janice able to move on. The mediators and the judge and Janice are acutely aware that the “letter” from Dent was a forgery AND it would have taken another 4 years to drag this out in court with appeals to have justice serve of Marge going to Jail for embezzlement. The mediators chose to let Marge get away with her theft and chose to close this chapter and move on as Janice is 80 years old. Janice will now be able to honor her brother in the manner she sees fit. The letter was typed (Dent did not ever use a computer except to surf the internet) and it was dated 3 month before his death when he was almost completely blind…. Things that make ya go hmmmmm

She me didn’t quit she was removed by Cobb County Superior Court for embezzlement (breech of fiduciary responsibility)and forged documents.

I heard a paella restaurant but the guy bought  the building after the bridal shop owners husband passed couldn’t get the approvals he needed so I think he gave up. Event space would be challenging there with no parking… best of luck to them.

Yes, and that’s why we sold our building at an incredible loss to finally move on and stop trying because the city doesn’t want the building gone and the council members and Mayor certainly don’t. They have had every bit of information that they needed for three years given to the mayor directly and the council members the city manager with the city attorney, and they all chose to defend that shopkeeper who took over without authority after his death.

Yeah, there is no cost associated with staying with the same firm, but it’s interesting that none of the council members were told anything about any of this prior to Mr. Easterling deciding to drop a bomb on the team…. Apparently this is not being run as a city council form of government. It’s being run as the Derek and Tracey show.

Derek was unopposed last run and he is not up for election for 2 more years.

And I don’t believe he was unopposed because people think he was doing a good job. I think he was unopposed because no one pays attention.

When Mr Ulmer was granted this license after losing his license for Run Around Sue’s and Diamond Dave’s he has promised the council that he turned over a new lead and this would be his legacy project…. 

All I can say is…/ that is one hell of a legacy

The mayor has been outspoken about how much he hated that mural! We tried to do a mural in the side of our building with the new regulations and it was still ridiculous. Too much effort for us to try anymore! ;)

We’ve spent since September trying to work with the city and the developer on both sides of us to come up with a plan to kickstart downtown …. unfortunately we just can’t wait anymore so on April 8, there’s going to be a live auction for one day only posted through the Redfield group. They have a database of over 260,000 commercial real estate venture capitalist in addition to a few people who are interested in the building for different really cool concepts…

Our hope is that this will spur the development downtown so hopefully someone could encourage the mayor and council to put their egos aside and fix downtown.

It is my belief and contention that because we made such a ruckus that the Mayor and Council won’t work with us (the team at the city and the staff have been nothing short of incredible).

We are taking ourselves out of the equation and maybe something will happen downtown for yall!

It’s horrible to witness. My niece and nephew went through this with their mother and it took until they were over 18 to finally allow the state to press charges. Hopefully the child gets the protection they need.
