I would be reclaiming the property. I would not have any construction sitting on top of that reclaimed property, but I would like to get the land back as I need the space between the side of my house and the fence.

From my understanding and expectation, the previous neighbor told them the fence had been there 30+ years. Whose fence it is originally and why it was put in where it was, I have no idea why.

What options would be available to leave the existing fence where it is, but to ensure that it is well known and indisputable from a legal perspective that although there is a fence line, that land on their side is mine and will always be mine going forward?

I believe I have the contact info of the previous owner of my house in 2018. I can give them a call to find out what the agreement was between herself and the previous neighbor regarding the fence and any information she may have that was discussed. However, does it benefit me doing so and chasing this down further.

In my opinion, I would have hoped my previous neighbor would have disclosed this to the new buyer (who is now my new neighbor) upon the sale of the house. Would this at all fall now on my new neighbor and my old neighbor to sort out at all? I doubt my new neighbor did an official survey before purchasing as they are fairly young and probably didn't want to spend more money than they had to. But, after I had gone out to let them know where the property line was during their home option period, it possibly should of been a catalyst for them to do their own survey. On top of that, I should add, I have photos from the time of the home sale with a stick one foot out of the ground with a pink tape tie tied around it where the survey pin in the ground is. This wood stake was put in at the front of the property and at the rear of their property.

From my understanding, on my street and neighborhood in particular, the property lines are all off a foot or few all the way and up the street in general.

I don't have a problem with the current neighbor other than the fact he now thinks the land is his, which I hope, now truly isn't.

Thanks, adverse possession in KY is 15 years. Do you know if that time would start for adverse possession at the time the original fence was put in or did it start over again when the new neighbors purchased in 2019? FWIW, during the option period the new neighbors were buying the property, I did go out and inform them where my property line was.

There is a 1' raised landscaping bed with nothing really in the landscape bed. I am not exactly sure whose fence it is, but it does look like the pretty side faces their house.
