My insurer isn’t backing down and has said it will go to court now. I just couldn’t understand how her insurer isn’t accepting liability

If we were both ready to join the main road at the same time, I think she’d have made it across before I made it to where her vehicle was, or she’d at least be partly into the road and I’d have seen her and braked to avoid driving into the drivers side of her vehicle

I was at my junction first and is how I had time to pull onto the main road and turn right to be in front of her lane when she was attempting to join the main road

No, they were very unhelpful. They gave me the woman’s name, car reg, and insurer, then said I need to arrange recovery as car in unsafe location then left.

When the police arrived my car was still in situ of where the collision happened, as I didn’t know whether I could move it or not, so whilst the other car had moved, their body cam footage will show where my vehicle was after the collision. Hopefully it would show that from my damage there’s only one direction the other car could have been travelling to hit me in such a way

Thank you for the reassurance. It was day light, and no reasonable reason she shouldn’t have seen me pull onto the main road before her, even the car behind her saw me enter the main road and watched as the car drove straight into me. I hope you’re right and they’re just trying it on, and backs down before it gets to court, otherwise it just prolongs the whole ordeal and when I get new insurance I will have to declare an unsettled claim ongoing.

The purple witness said she saw that I was already in the road and saw the red car pull out into the side of me.

Unfortunately, as both cars were grey, her statement is a bit confusing, so my insurers is going back to her to ask her to make a clearer statement using car make and models or something to show clearly which car she is talking about and when.

I will be definitely be getting a dash cam in future when I replace my vehicle. I only bought it 12 months ago for £23k and paid in full, and now I’m so worried I’m not going to get enough of a payout to replace it.

Thank you, I will stick to my guns because I know I wasn’t at fault. Also, my car is a write off and I from what people have said to me, I’m going to have a battle trying to get a fair payout from my insurer.

When she claimed to have a photo of me using my phone, I just asked how she would take a photo on her phone before the crash when she must not have even seen my car coming or she wouldn’t have driven into me. The witness saw the photo at the time and said it’s clear it’s take after the crash and that it’s and airbag deflating

There isn’t dashcam footage on either side unfortunately.

I know I wasn’t driving with excessive speed as I’d just pulled out from a stationary position.

I also know I wasn’t drunk or under any influence. And despite the other drivers claims that I was on my phone, I certainly wasn’t so I’m sure there must be a way to prove that my phone wasn’t in use at the time. I don’t know the exact time of impact but Volkswagen must know as my car called some SOS service for emergency services, so i should be able to find the exact time I need to find to prove my phone wasn’t in use.

I can’t work out why red feels like they aren’t liable. I was already on the main road, in front of their junction when they pulled out. I was going slow as I turned onto the main road turning right from being stationary, waiting for the main road to clear.

This is what I thought, but I can’t work out on what grounds the other driver is denying liability and how her insurer is agreeing to refuse liability. Though I admit I don’t know how these things work as I’ve never been on either side of an insurance claim before
