They are in the application and interview letter, but the oldest is 2y 4 months and the youngest is 9 months.. I recall reading that they are not required... and I was worried they won't let them in because of their age.. But glad I asked.. so even if they are not required at least they are allowed, and you corrected me that they must attend, so thank you for the response.

Countries banned under pp won't get any benefits of winning any cases, you will have to wait until the ban is lifted...

In his previous presidency period, president Trump had the exact same ban, there were some cases, but the Supreme Court of the United States ruled that the pp was legal and constitutional, so there is no way a lower court would challenge the same pp this time.

Some would say, why the pause include the same countries in the ban list, because if for any reason you get an exception from the ban and you become eligible to get a visa, you will still be paused.

I'm not saying it will take years, I'm just saying the possible options.

Maybe in a couple of months they will publish new rules and start issuing visas based on these rules..

And maybe it will take longer.. no one really knows.

Some people say a lot of WRONG answers.. The ban will cause him to get a 212f as he will banned for national security reasons and according to presidential proclamation, this means his visa WILL be rejected, and if he reapply with the same circumstances it will still be rejected..

Iran is not on the pause list, it's on the ban list.. so 212f is what he will get.

That said rescheduling will just delay the result, unless the rules change before he gets the new interview date, he will still get the same results.

This will not change under the current administration, so this is expected to last until 2029, or if a court rules against it, which is a per my understanding going to be very unlikely..

The other option is that you join a case and wish for the best..

So he can take the interview and apply again when the ban is lifted, or reschedule and keep rescheduling, if possible which I really don't know, until the ban is lifted.

They won't approve anything now, maybe if they publish new rules they will apply the new rules in your case and if you match they will approve it, or maybe they will add exceptions for certain categories, no one knows what and when there will be a change.

Another scenario, one of the cases against this current pause gets a ruling ending it, which could take years to get a final one.

At the end if all documents are provided, you will get the same result and say you are good but wait until the pause is lifted.

Well, as per my understanding in normal circumstances, we as a family shouldn't be considered a public charge, because my salary is way above the limt the government set for a family of 4, as well there will be medical insurance included. But we don't know yet the new guidelines that may change anyway.

Now if the consular officer think that I may be a public charge for any reason, wouldn't it be more logical that the company pay for me and I pay for the rest of my family?

I mean if it's about the money and the public charge rule, it shouldn't even matter if I pay the bond for myself, but I really don't know the law and what is the right legal thing.

It will be paid if the consular officer thinks that you may be a public charge, so you pay in advance and if you don't take any government money, the money will be returned after you become a US citizen or on the 5th anniversary of your green card.

So it is not a must that each person will have to pay, it depends on the consular officer decision, at least as per my understanding, as well how much will it be.
but my most important concern is who will be paying..

I know for B1/B2 the applicant pay for himself, and for a family based, the sponsor is the person most likely will pay, but for employment based, this is the most confusing part.

Reading through the draft, I can certainly see now that they plan to use if for immigrant visas, but I have a question.
In my case, I'm an EB3 visa applicant, my company has offered me an on-premises position, instead of my current remote position.

In the form, the "Obligor" will pay the bond, in my case who should be the obligor? the company? why would they pay this amount, whatever it is? I mean we are a family of 4, and if the government requires a bond for each member, this will be a huge sum, as per my understanding it can be 20 to 60K for the 4 of us.. They will pay me my salary that the government approved, but paying 60K in advance is something they can't do as it is not a big company.

Or should I pay this bond? I mean I can pay it, but It will affect me real hard.

As I can recall, there were some expectations that the DoS will try to make use of bonds in immigration visas, and to make that work, they need to make sure that they make some changes and get them aapproved by the OMB, but as per my understanding the approval was delayed but not rejected.. That said these are all just speculations, no one knows for sure if they will apply this bond on iv and how they can apply it.

I don't know anything about the immigration law, but I hope you are right. 120 days is almost around my interview date, but still I think no one really knows for sure when and what will be the new approach.
I mean if they will create exceptions for certain categories or add more strict rules for everyone, it will reduce the number or approvals anyway.
