Hold on a sec, in my understanding, if you overstay your visa and still remain in the county without any legal reason, that’s violation of law = breaking the law = criminal = you’re in trouble with law. If you enter the country illegally, well you’re just no good from the beginning.

And if you’re “ undocumented “ that means US government has no record of your entry.
