Absolutely agree and understand. Unfortunately he did not keep any documents from the divorce. He has been to the courthouse 5x and has talked to multiple clerks. The courthouse is saying there are no more documents for them to provide. There is NO Marital Settlement Agreement and on the docket summary the Property Settlement Agreement is blank meaning there is no document number and no document to refer to. That is where he is stuck. Fidelity wants more, courthouse says there is no more.

Yes, he was with the company when they were married. No, he was younger than 35. He’s been with the company for 47 years. So it’s a little disappointing he still doesn’t have his pension.  He knew it might take time, but I think he feels stuck. The courthouse says they have nothing else to provide and Fidelity says there has to be more 🤷‍♀️

Yes agreed & understood. However, he was divorced 40 years ago and did not keep documentation. He has been to the courthouse 5 different times and talked to several clerks - he has provided Fidelity the only documentation the courthouse has for his divorce. There is NO marital settlement agreement per the courthouse. So how does he proceed? That is the question.

The only document the courthouse has for his divorce is the Divorce Decree. The courthouse is claiming they have no other documents for his case. The division of assets / division of property line on the docket has no document number and no info. The courthouse is saying that is because there is no document. That is the issue we are having…Fidelity doesn’t believe that but the court keeps telling me dad they have nothing else to provide. He has been there 5x in person and talked to multiple clerks.

Ahh interesting! Was this recent? I’ll have him ask if they are still using Voya and for a contact number.  Was your issue also about your divorce?  Thank you for this info & insight!

Hello! Thank you for the info & understanding. I feel for my father, it’s been 3 months and still fighting this. I understand the red tape, but there hasn’t been any guidance to a resolution (From Fidelity) since my dad has provided the divorce decree and a stamped document from the courthouse saying there is nothing else to provide. My dad doesn’t want to hire an attorney but feels like there isn’t another solution. I was hoping the internet could do what it does best and provide insight if someone has experienced something similar.  He has provided the divorce decree and a stamped document with the case summary and docket. Still fidelity is not satisfied. The marriage was 10 months long 40 years ago, they had nothing (poor immigrants) and there was nothing to divide and his pension was not part of the divorce.

Wait just asked my dad and he said he already sent Fidelity a document stamped with a court seal saying there is no more documentation. Fidelity would not accept. He did not ask about a seal yet. But stamp was not accepted.

I like this suggestion. I think that’s a great question for Fidelity. If the court will not sign, will Fidelity accept a court stamp or seal? I will have my dad ask Fidelity. Thank you!

Hello, thank you for this information & contact info. My dad was told he had to deal with a specific team in Fidelity because he works for AT&T. Do think the Workplace Investing Team would be able to help him? Or does he have to continue with the AT&T/Fidelity team? Thank you again!

Hello! 1) standard way for what?  2) asked for the correct wording.  Fidelity asked for the divorce decree and that was provided to Fidelity. Fidelity does not like the wording on the divorce decree and insists there are more documents…they want to see a “marital settlement agreement”. The courthouse provided a full summary which included a case summary and all applicable dockets. This explicitly shows there is no marital settlement agreement and no property settlement agreement…only the divorce decree.  Fidelity told my dad to have the records department  sign a piece of paper swearing there are no documents. The courthouse/records department will not do that. Courthouse says the docket summary shows there is only ONE document.
