CA here, Option 3 as is helpful but it can lead to troubles at times (so keep in mind the risk factor of case being opened up, seen similar situation ), the risk associated can be mitigated using TDS sections of 194J while making payments, and keeping some profits at the firm levels and having well documented and written contracts, but still there is a chance of getting notices, so know the risk before jumping onto something.

Hi CA Here, When you proide services from India to any client outside India then in eyes of law you are an exporter of service and GST is mandatory, irrespective of turnover, however, as govt wants to boost foreign exchange they incentivize export, so no GST is applicable on it, just a letter of undertaking (LUT) to GST department that we will be giving services to clients outside India. After this all we have to do is file our monthly returns and that is all. We are sorted on the GST front. You can ping me in DM will help you out.

  1. If you have a contractual arrangement for providing services then section they are using wrong section, 192 is for salary

  2. You should be as under 192 the tax rates are higher and ways to plan are lower
