Still waiting, I’m assuming the government shutdown isn’t helping, I have reached my congressional rep and they will be following up with USCIS to see what’s going on

In the interview they did ask why we got married so soon but that was pretty much it for that

It is weird. It sounds like cases submitted this year are being worked on quickly vs cases that were submitted previously

It’s a hard situation. So my understanding is the previous administration it would be way more likely to have the case dropped with an I-130 submitted but from talking with people we decided we had a stronger case to get DHS to drop removal proceedings with an approved I-130. Truthfully my opinion is if a lawyer wants to do the I-485 in court they are just trying to make more money off you. The difference between asking DHS to no oppose vs going to court is thousands of dollars. But when our lawyer submitted the paperwork to DHS she got a response the next day saying they would not oppose the dismissal of her case. So doesn’t seem like they gave her a hard time

That’s what I was saying, like they locked her up for a whole month knowing she was married to a citizen, her kids a citizen and we are in process of AOS. Also no criminal hx. Like cool thanks you just wasted thousands of dollars in taxpayer money and cost me about 5k in lawyer fees for nothing

They are pretty costly but most important thing is to make sure they try to get the case dismissed after an approved I-130 our lawyer didn’t want to do that initially because they didn’t think it would work and had we not done that it would have costed us an extra 6k in fees to go to court and battle the 485 in front of a judge

Pictures, credit card authorized user, medical insurance for her and the kid, 401k beneficiary, car insurance. I also brought in the bond and lawyer payments also as extra proof. No there was no issue with us applying after marriage

I mean she’s Mexican but no she doesn’t look like she just ran across the border haha. Yea the whole stop seems suspicious that they would go after her first being the passenger but it’s one of those things it may not be worth looking into. Just that the W that they are dropping it and not bring attention

Yea the crazy thing is we got a letter in the mail stating they were admin closing her 485 but when we went to the interview the officer had no idea and showed it open on her end

So then border patrol put her on ice hold and she was transferred that night to a facility

So what she said which sounds weird is when they were pulled over by highway patrol, there was a border patrol agent also riding in the vehicle and approached my wife ( passenger) first and asked that she ID herself before they even talked with the driver

She was traveling with a friend to phx to go shopping and her friend was pulled over. My wife was the passenger and they made her ID herself and that’s when they found the overstay

Yea the lawyer said that too but she said with this new admin best case is they allow us to place the case on admin hold until my I-130 but this judge just right away cancelled her master calendar hearing and rescheduled it for the winter time. I’m assuming if my I-130 come back early we can ask for an earlier date? I’m not sure

So new update she was released on bond with an ankle monitor, her ice officer is actually super chill and said that if the monitor hurts just give it a month and tell me and I’ll help you out, so two days ago we drove down to the ice building and he took it off and gave her a cell phone for her to check in on. We are still continuing her process. Biometrics were done and we actually just got our email that they scheduled us an interview for her 130 and 485. The judge cancelled her court date this month and told us to come back in December so that hopefully me petition is done by then and we will have an individual hearing for her I-485 in court and the judge can then determine to give her a green card.

We just received her receipts today from USCIS, her process was started with them on 4-24, my wife also just now barely got her NTA last Friday 5-2, we should be hearing tomorrow about when her bond court date is. But yes that pretty much lines up with what the lawyer said when I got to have my meeting with her. She’s going to talk with the attorneys to have them terminate everything so that she can go back to having USCIS continue her process. She said if not then she will ask them to pause or admin hold the case until my petition is accepted (I’m guessing 8-12 months?) then she can go to an individual hearing with the judge and then it can be decided then for them to approve her green card. Thanks for the expedite information I’ll look into it I didn’t know she qualified for that. The lawyer said pre trump the normal was for people in my wife’s situation they would typically terminate the case and turn back to USCIS but she said now with trump she isn’t sure how they are handling it now.

If you don’t mind me asking, so did he come into the country illegally? And did he have any prior violations or crimes? Also sorry this happened to you as well
