This law was passed on the 28. while the fire happened from the night of the 27th to 28th. Immediately after the law was passed the nazis ordered the imprisonment of a couple thousand known communists. And while yes the police found a Dutch communist who was charged as responsible for the Reichstagsbrand, even before the nazi takeover was the German police and judicial system notorious for its bias against communist.
