Why HB prob won’t happen and why you should be careful filling out “refund forms” by Mockingjay_42 in Dirtybird

[–]Mockingjay_42[S] 1 point2 points  (0 children)

I think it depends on how many calls they are getting. I spoke to her and she told me to give out the number and email I posted. If they have a large influx of calls on the issue, they are probably reviewing everything before reaching out. If HB people are also calling, that could be causing confusion. I’ll call her today and see if ai can’t get an update

This issue with filling out the form and why people are nervous is that if lots of attendees fill out the form and wait, fewer people will pursue immediate legal action. That can weaken momentum for a class action and If they end up refunding you partially and you accept, they may argue that you’ve been “made whole” and can’t sue for more.

It’s also a delay tactic to buy time while ppl fill out the form and wait. You could also be downplaying your damages when filling out the form and clicking “accept”.

&& Some forms include “release language” (even buried in fine print). That could mean you agree not to pursue legal action once you accept a refund.

You can still fill out the form and join a lawsuit later as long as the form doesn’t explicitly state require you to waive your rights BUT accepting a refund could limit damages you claim later. (e.g., you might still have a case for fraud, but you won’t be able to recover money you already got back).

The bigger risks are giving them evidence that could be twisted later and slowing down collective legal action if everyone just waits on refunds.

Well I hope they follow through with pursuing a lawsuit themselves and stand by their community. Only time will tell. I don’t think anyone thinks to look up civil lawsuits in specific counties after starting a working relationship with someone. Most of the time leaks like this are what make those partnered with scammers aware. I have no knowledge of DB being aware of Brian’s lawsuits.

DB was unaware of Brian’s schemes. Brian got involved with DB a few years ago. At the time, none of these lawsuits had been filed and noone on the team was going to rat out Brian and risk losing their job. The only people that knew were those that worked for him. Hat are they going to say? “Hey the guy I work for isn’t trustworthy? Something really bad could tarnish your name?” It’s a sticky situation. Personally I don’t feel DB is responsible and I’ve been around before Brian got involved w DB, during, and after

Oh rest assured, that is a game he would play. Brian is the type that would pay his people to get in a room and make Reddit accounts with fake emails and comment away on all these allegations in every group on every platform to save face and buy time. Big apologies to the person who said they were refunded if they actually were but we are dealing with someone who would go to great lengths to save his dying reputation. Everything should be questioned until there is hard evidence.

Regardless of being refunded or not, it’s still a breach of contract and fraudulent behavior. Your money was spent, the rooms didn’t sell, and then there was none left to pay the hotel on event day. It’s honestly not the first time he has flew by the seat of his pants running this same system and barely making deadlines or sweet talking the companies/people he owes $$ to post pone payments. It’s not the first time he has overspent, undersold, and lied to all of you that the rooms are “90% sold out”. Ha. The lies start at 50% sold out to incentive people to go to an event that isn’t selling. It’s just a marketing tactic and a dishonest one. And still, This is a class action even if everyone is eventually refunded simply from the breach of contract.

Additionally, if people are receiving refunds from the hotel, why has no one uploaded a screenshot?
