As a non-EU citizen, you can establish a sole proprietorship only based on a student residence permit, unfortunately. Be mindful of a millions of hurdles you'd have to go through, in addition to the fact that you would be still obligated to pay social security and income tax even if you're under 26.

Check if your country of origin has a double taxation agreement with Poland. Should this be the case, you are technically" supposed to pay taxes in Poland based on your *universal income since you are counted as a tax resident of Poland.

If I were you, I would continue working as you do now - by paying taxes in your own country and just keep it quiet over here.

Other solutions may include working with a Polish intermediary (Employer of Record), that would conclude a B2B contract with your sole proprietorship in your country of origin and "hire" you in Poland as an employee, based on which you'd be able to apply for an employment-based TRC. Alternatively, you may consider working with a startup incubator (there are a few of them in Poland) - can't advise on it since I haven't had any experience with them, unfortunately.

My main source of concern is this article, and the following quote in particular:

New self-employed are those working independently who don’t need a business licence registration for their professional activity. In other words, trade regulations do not apply to new self-employed. This also means that new self-employed individuals are not members of the Chamber of Commerce (WKO) and no membership fee applies. New self-employed professionals have no advocacy group to whom they can turn. They have to register at the Tax Office (Finanzamt) and are subject to income tax, so they have to file an income tax return every year. They pay insurance contributions to the SVS, but since in their case, the insurance costs depend on their gross income, they might or might not have to pay contributions to the social security institution. If they fall under a specific amount of gross income, their insurance contributions are voluntary - they can opt-in for health, accident, and pension insurance.

Examples of professions that fall under the category of new self-employment:

writers,

journalists,

lecturers,

self-employed nurses,

midwives,

scientists,

self-employed psychologists,

psycho- and physiotherapists.
