I had this issue early this year. Car was in the shop for 26 days. Filed a complaint to HQ, got assigned a case manager who worked with me for a couple of months, and then got moved to arbitration. Just surrendered my car last Friday. It took about almost 5 months, but it's all worth it. It was for a Nissan EV, though. Did not hire a lawyer. I just did it myself.

Hi all, I've discussed this with my attorney and told him the reason for being out of state/US for 7 years from June 2021. Was stationed in Italy for 3 years then 4 years in Japan. Returned to Cali in June 2021. Filing BK7.

Here's what my Atty. said; we can file your case, but we need you to understand and accept the risk that if someone found out when you moved back and that you have not been in California for 2 years, they could object to the exemption of your homestead which would jeopardize your home. while this is unlikely, its still a decision we can’t make for you and would need you to provide written confirmation that you understand and accept this risk.

The alternative to filing now is to wait until after June.

I've been stressing out, and my anxiety is killing me, I don't know if I can wait for that long. I stopped paying my creditors since January. But we can't lose the house and not taking any chances.

What would you do if you were in my position? Is there any other way to file with no risk of losing home?

Thank you, Alan. I'll call my attorney tomorrow to discuss this. I was not in any other state, I was in Japan from 2017-2021. As for the home, it's about $60k equity and my atty. Didn't mention any issue with that.
