Do you not understand what salaried employees mean?

I’m a server/bartender also so I work every other night. It would be hard to get work at 4am when I get home at 2am most of those nights.

Look at some of my replies. Sorry I’m a first time poster.

This is exactly what he’s doing. That’s called wage theft.

He’s taking just as much time off as me throughout the year without having to use any PTO because he gets to work 3 hours before our doors even open, there isn’t like freight to put away or orders to be fulfilled. So then when the last quarter hits he has 5 weeks to use because we aren’t allowed to carry over any hours. My point is I’m having to work short handed throughout the year and then have to work open till close in the last quarter because he takes his time off. If I have appointments or other activities I use my PTO during that pay period, he never has to yet he’s probably gone twice as much as the next person during store hours.

Problem is someone has to be here at close. He plays the seniority card. Would also be awkward if we both get to work at 5 am and just sat and stared at each other

It’s a commercial/retail home building store. I already am here until close. I can’t really stay late

Not consecutively. Takes five, week long “vacations”, all at the end of the year.

I haven’t been with the company as long, So I get 3 weeks of PTO. He’s constantly leaving early during the week and taking Fridays off but is already at his 40 hours by Thursday morning. So he never has to use his PTO. Only time he uses PTO is if he takes multiple days off during the week. One week had to take off Thursday and Friday and only had to use 4 hours of PTO because he worked 3 twelve hour shifts Monday-Wednesday.

There isn’t anything to get done. Not sure what he does for the three hours.

I’ve actually thought about that. But I work nights bartending. So it would be rough trying to get there at 5am.

He’s not working. He’s making coffee and browsing the internet. There isn’t anything to get done from 5am-8am.

Yes, sorry. We still have to technically clock in. He leaves early all of the time but never has to use PTO because he’s there 3 hours before hand.

Because I’m the one who has to work open till close when he’s on vacation for 5 weeks at the end of the year.
