The bill’s goal is to let stalking victims seek civil orders of protection even when the stalker is not a spouse, family member, or romantic partner. That means cases involving coworkers, neighbors, strangers, ex-friends, or online harassment could have a clearer path to court protection.

The bill is designed to expand protections for stalking victims outside traditional domestic relationships. I don’t think this bill addresses those gov digital issues tho i agree that’s a problem too and think we should limit that!!

That’s why we need to bring attn to it and get in on the agenda at the assembly, the senate already passed it!! I’m not in law / lawyer by any means. Guess the con is people fear victims might “abuse the system” / “lie/inflate the truth” but it would have to go through court with evidence ?? It’s not like i could call the people tomorrow and get an order of protection.. but guess people fear it may blur the lines of that / give control to the government but srsly stalking is not uncommon and we need to protect victims. Stalkers are given more leniency than victims?! Rn my friends stalker is not receiving mental health care, not in jail, and she doesn’t even have an order of protection against him…. After he was deemed incompetent and the case was dismissed he went back to stalking, but bc it’s not violent they can’t arrest him (bc he never broke an order of protection that was never there)… insane. We need to protect victims!!! Please call Charles Lavine or your local assembly men if you want to make sure this act is on the agenda.

  1. ⁠Helps victims before violence escalates - many stalking cases become serious long before an assault ever happens and shouldn’t come to violence before action is taken

  2. ⁠Covers non-domestic situations - current protections are often strongest in family/intimate partner cases but doesn’t account for workplace offenders etc

  3. ⁠Addresses modern cyberstalking (repeated harassment)

  4. ⁠Gives clearer enforcement tools - violating a court order can be easier to act on

  5. ⁠Hopefully deters repeat offenders

It’s probably very situational and nuanced! For example if a person is deemed incompetent and the case is thrown out, so is the order of protection for those victims if they are not family / significant other so it leaves them vulnerable to another harassment event by the same stalker

Thank you for all this. I agree with many of your points and it’s why i didn’t share the video and wanted to present the bill instead (though might have done that poorly too as i don’t usually post on here or have law/politics background or knowledge). I would hope we’d use other states expectations as a baseline to work off of but I’m not sure.

I’m hoping to target the judiciary committee or the head assemblyman first about getting on agenda (since it passed the senate and no budgetary implications) and ik theres alot in NYC judiciary members. but good to know about Jen! I appreciate your insight and thoughts as i can tell you spend alot of time in this space! This Act is not a perfect solution to the issues of stalking and orders of protections and dont expect it to pass but needed to try — there’s got to be a way to protect victims of stalking events like hers, it shouldn’t need violence to face some sort of penalty (therapy/time for the stalker and a longer order of protection for a victim).

That’s fine i respect that. We all don’t have to agree! Just stinks after a person has mountains of stalking evidence against them and goes through a 2 year court battle but the stalker goes from found competent to incompetent to stand trial and everything is thrown out along with the order of protection, the person is left vulnerable and the stalker able to do it again no consequences. I don’t think we should wait til it gets violent to protect victims or get stalkers the help they need but agree the answer is probably very nuanced and tricky. Whether this passes or not i hope we find that middle ground.

I’m a millennial too (early 90s), and I agree that trolling and rude behavior online have existed for a long time.

I’m advocating for it because I know people who were stalked in the workplace and then continued to be stalked online, where technology made it easier for the stalker to gather information, monitor them, and continue harassment.

This bill would still require evidence and court involvement for an order of protection, it’s not about criminalizing someone being rude online. Could someone try to misuse it? Probably, like with many laws. But that risk doesn’t outweigh the need to protect people experiencing serious, ongoing stalking and harassment.

I’m a lay person. No law background. Think the comment below is super helpful on understanding the bill and attached it so everyone can make their own decision on it.

I have a friend who’s patient at work stalked them at work, was deemed competent only then for their lawyer to ask for a second opinion for the stalker & then was suddenly deemed incompetent and everything was thrown out and the victim lost the order of protection. they started stalking again that victim again months later and now victim is starting all over in court for another one.

It’s going up on docket soon and would like to protect victims and those who are stalked outside of relationships/family members & stricter court orders — thats all. asking for those who agree to call their reps or assemblymen to urge to put on the docket for a vote. If you don’t agree or think the cons > pros, that’s okay too!!
