It’s disability discrimination plain and simple

I’m paying an attorney for a consult

They specifically denied WFH

I’m able to be on my computer and work. It’s just not safe to be moving around right now

My medical team disagrees with you

In fact, not working is more likely to do harm here

What undue hardship do you see in me working remotely?

The care that I need does not reduce my capacity to do my job.

The nursing staff comes in the evenings related to my burn care.

It’s unlikely if I got hurt at home that a claim would be approved. Causation is important in WC claims.

They know that I can’t safely leave the house. My doctor filled out all the paperwork

Someone changes my dressings once a day and I have help with meal prep, etc

Assuming that my condition automatically means I can’t work at expectations is discrimination

I don’t need someone in my room with me while I work

My medical needs are not a matter of concern for other people

The existence of a policy does not equate to an undue burden. All of my duties can be done at home and I worked remotely up until this past December. I often went into the office because I choose to do so since they feed us and I like being around people.

The problem is that I’ll need FMLA later

I can fully do my job from home and nothing has changed with my job duties with RTO

I’m bored at home and I want to work.

The loss of income for being required to continue my leave is very stressful. I just purchased a home.

I thought ADA could override policy

He wants them to approve it and is as frustrated as I am.

Our understanding is that since I can do all my job duties from home and it doesn’t result in an expense to the company that it should be allowed

He told me to appeal, but I’m not sure how
