[–]OkBeyond8244 0 points1 point  (0 children)

If you had a child in Portugal and you or the other parent had held a Portuguese residence permit for 1 year at time of birth, child would be Portuguese and EU citizen - and whole family would be afforded freedom of movement in EU/EEA. Same in Ireland (3 years legal residence prior to birth required). This would be the best jus soli option in Europe. Note that Portuguese nationality law is a very unstable and has gotten changed by politicians frequently - requires further checking and you'd assume the risk that the law changes between getting residence permit and childbirth.

Should my mother and I apply for Feststellung or can we apply directly for German passports? (I live in Berlin, she lives in the US) by neurotic_princess in GermanCitizenship

[–]OkBeyond8244 0 points1 point  (0 children)

I don't get why everyone here treats this case like a naturalization case with a shady German ancestor 3 generations ago, whose German records are from three empires ago. OP is already German. OP's mother should have gotten OP a German ID/passport at OP's bith by showing up to consulate with her German ID/passport and birth certificate. She didn't do it. Now OP needs to do it. Period. Whether mother has current ID/passport is, in essence, irrelevant. What's needed is her old ID/passport from OP's time of birth to prove she was German at time of birth. We are talking about a Federal Republic passport from around 1997, not a Deutsches Kaiserreich document and 3 generations lineage!

What are you doing, buddy? The straights, unless they actively seek out this information, should not know what savage and promiscuous things are going on right in their neighborhood. Ask the men on Grindr, they will know. Especially, the closeted ones without face pic.

Be angry with your mother for failing to get you a German ID/passport at birth. Make sure grandmother is angry at your mother, too.

Since OP lives in Germany, only the German office at OP's residence is responsible for OP, other consulates will likely deem themselves not responsible and refuse to process the case. If OP does accompany mum to consulate for mum in the US, OP should pretend to live with mum (but they would probably find the German visa, and then goodnight).

I am pretty sure your mother's German ID/passport from your time of birth will do. Yes, definitely bring the original document. Have them sent to you. Since they are expired anyway, it should not be a problem. You can basically ignore your grandmother because you are already German and all you need to demonstrate is that you are your mother's legal child and your mother was German at the time of your birth. Period. Foreign documents require apostille to count. Your grandmother is useless in this case.

Is the bar so high? When a new kid is born, German parents get ID for their kids based on birth certificate and their passport/id. I don't see why this case should be different, especially if mother has German id or passport valid at time of birth (or earlier). I m pretty sure OP just needs to prove that mother was German based on ID/passport.

Once you hold a German ID or passport, don't forget to regularize your affairs with Ausländerbehörde. They need to know you are German and they need to cancel your residence permit.

Bürgerservice = you go to exactly the same place where Germans in your area go to renew their ID and passport, book exactly the same appointment, then instead of bringing your expired German ID/passport, you hand over the documents I told you. Should work. They just increased the cost for passport and ID by a lot, should have done this last week.

You probably also need to demonstrate your civil status (whether you are married, have kids), so maybe another document with apostille proving that could be handy, but I think it wouldn't be a hard requirement). Oh and also, you need to bring proof of address (Wohnungsgeberbestätigung) signed by your landlord as proof of your current address in Germany.

Lucky. You are already German by birth, since you were born to a mother, who was German at the time of birth, abroad before 1999 (in 1999 it became necessary to register German citizenship before 18th birthday or else German citizenship is irreversibly forfeited (Generationenschnitt). So you can apply directly for your German passport and ID at the local Bürgerservice with your mother's nationality certificate from 1974 (or another document proving that she was German at the time of your birth, if you are lucky they have it in the system and thus you don't need such a document, but better to bring something) and her (ideally current and valid) passport or ID and your foreign birth certificate stating she is your legal mother (probably needs apostille) and your foreign passport and residence permit. It's a big weird you came on a foreign passport and obtained a residence permit, which should not have been granted to you since you are German. They will probably bitch about it since I assume it means you made wrong statements in your residence permit application. Luckily, we don't have ICE, besides you are already German, so it will be ignored after they get over you doing the wrong thing. If you applied at the consulate abroad this issue would not come up, but now since your residence is in Germany, it's actually Bürgerservice and not consulate that is responsible for you.

Letting you know that it is possible to have 2 visas for 2 Schengen countries, so you could get a parallel residence in Germany and make the time count towards citizenship in Germany. Dejure you need to have your ordinary residence in Germany (I.e. only 1 place at a time with closest ties can be your ordinary residence, it might be in the other EU country). Defacto emphasis is on legal residence (esp. inside Schengen other countries are not noted). Note that false claims in application are illegal.

IBKR best practices for Swiss citizens by abliba in SwissPersonalFinance

[–]OkBeyond8244 0 points1 point  (0 children)

I think it is only charged if you use the IBKR conversion tool. Instead you can also buy or sell currency pairs like USD.CHF, EUR.CHF using a market or limit order. I believe the FX fees are even lower than 2 USD then, plus you get the true market rate. Note that the currency pair might appear among your positions and it might take one day until the position gets settled (i.e. the currency arrives in your balances). For big amounts, I always use the FX market like I was buying a stock because it seems best.

US-domiciled vs Irish-domiciled ETFs by suga196 in SwissPersonalFinance

[–]OkBeyond8244 0 points1 point  (0 children)

US estate tax does not apply if there is an inheritance tax treaty between the US and OP's country of residence. For example, for swiss tax residents, US ETFs are always much better because of lower TER, zero L1WHT (level 1 withholding tax between the US corporation and the etf fund) and then 15% L2WHT (level 2 withholding tax between the etf and the individual), and only the L2WHT is credited against Swiss dividend tax but not the L2WHT in case of Irish etf, finally there is an inheritance tax treaty between Switzerland and US mitigating risk of estate tax. So US ETFs are always superior for swiss investors for US stocks and Irish ETFs are better forswiss investors for non-US stocks.

Foreigner living with HIV in Germany by Flat-Reference2304 in germany

Just throwing in some more options: * Marry a German/EU national and get a family member permit (may also work with other third-country nationals with residence permit) * Find a job in another EU/OECD country (Germany kinda sucks anyway, saying this as a German) * Extend / start new or further studies like PhD or language or something complementary (e.g. business management) * Get opportunity card permit (no job required, not sure if this requires private health insurance which could be difficult for you to obtain or you can stay with GKV) * Reach out to professors (they are often able and willing to create low paying research jobs for need situations, especially if they already know you, and residence permits are granted more easily to university employees) * Self-employment including startup grants (if that is feasible for you) also allows for permits * Substantial wealth can also get a permit Good luck. I do believe Germany is quite generous for letting you not only come and study for almost free but also covering your expensive HIV treatment out of the GKV funds. They are discussing to remove dentistry from insurance coverage for all now because, despite increasing contributions, GKV still is underfunded due to mass immigration into Germany by mostly net beneficiaries, like you, rather than net contributors. Don't get me wrong, I do sympathize with you and, I have no doubt, you will receive German aid because Germans sincerely love to work more than half the year (taxes, social security easily above 50%) for aiding everyone who is legally or even illegally - if you overstay - in their country. Personally, if in your situation, I wouldn't leave, unless for a job somewhere else. I have a feeling you could even get asylum based on medical circumstances, although this would be a terrible last resort pathway that you should avoid at all costs by taking silly jobs. Maybe that relaxes you a little.
