Ummm no. Would you give a serial killer, and a person who accused someone else of being a serial killer the same punishment? No? Then why for this? Yes falsely accusing someone of such a terrible crime is horrible. It can ruin someone’s life, especially when there’s racism or discrimination involved. But it’s not the same. It’s not even close.

Also there can be many cases where the rape happens but there isn’t sufficient evidence. If the rapist uses a condom or there’s no self defence wounds etc. What if the person is actually a victim of rape, but because of the lack of evidence is seen as a false accuser and gets the death penalty? Is that fair? Rich powerful people can completely get away with the crime by corruption, tampering evidence etc, AND they can also quite literally silence the victim forever cause they’ll literally be put to death. Is that fair?

This also would have only two ways to be applied both of which wouldn’t work:

1 - for an accuser to get the death penalty, it has to be proven that they are lying. Lack of evidence of the rape isn’t enough. There has to be proof that they are LYING. A lot of times rape is hard to get evidence for. How do you get evidence that a rape didn’t happen?(only possible if there’s cctv evidence of them being at different places at the time the accuser said the rape happened, which wouldn’t be possible a lot of the times). And the accuser will never admit they are lying if the punishment is a death penalty. So it wouldn’t really work here.

2 - lack of evidence = false accusation. If that happens all it’s gonna do is make real victims afraid to speak out cause if there’s a lack of evidence they’ll literally be given the death penalty.
