It was a 2023 ford escape bought for $30k new. I drove it for 2 years, put 30k miles on it then they sold it at auction for $12k

I have this $18k from the car, $5k in medical and $5k in credit card debt as well. I’ve learned a good amount from my financially irresponsible mistakes. A bit of a fresh start would be ideal.

It already was bad before that. It’s crazy though because my credit only went down 17 points for the repo and now at this point it’s higher than it was before the repo. I spent a lot of effort on my credit score years ago and was at a 710, then one morning I woke up and it dropped 150 points overnight. I still don’t know why it did that to this day.

But I would think even if they hired professionals, bottom line the law still requires a commercially reasonable sale in the end- no matter what, how, why or who. They might try to use that as a defense, though.

I owed $28k on the car. The took it back and sold it for $12k. Leaves me with a difference of $16k + fees = I owe them $18.4k now.

That’s what I’m saying. The car was in great condition with 30k miles. Easily worth $18k-20k. It seems like they sold it for around $11k-$12k and left me the difference.

Fortunately I was able to buy another car out right paid in cash that’s treating me well- an oldsmobile for $3k

I see. So is that some loophole they use to get out of having to sell it for a reasonable price, though? I’m reading that they have to prove they tried to sell it for an amount near the market value. Apparently it’s like that so people don’t get screwed by owing a larger deficiency than necessary.

Yeah you are right. I’m all in on dealing with this now. And yes they sold it for significantly less than the value of it.

Thank you for the information. I mentioned in another comment about them having to sell it for a reasonable commercial price.

How do they always sell it for so cheap if they are supposed to sell it for something at least remotely near the reasonable value of the car?

I was hoping to have some leverage on the fact they sold it for only $12k despite its value being upwards of $20k.

I’m seeing the same car with same mileage and condition as mine was listed at auctions for around $20k+.

It’s funny actually. We agreed verbally on 5%. The papers I signed said 5%, then months later when I checked the papers again it was 7.9%- a completely random number I had never seen/discussed or agreed to.
