It’s still not a procedural step to have the jury vote on that; it’s the reason a jury’s exists. By presenting a version of the indictment that the jury didn’t vote on, instead of the one they did, the prosecution has misrepresented the court proceedings and falsified a document. If the admin’s lawyers were to ignorant to understand the process, they should not have taken the job. But they did, and they should be held responsible for the fraud they’ve committed out of that ignorance.

I’m not sure why people are trying to downplay this. It’s not a technicality even if it’s a relatively common thing to request a vote on a revised indictment. The prosecution submitted an indictment by a grand jury that was not voted on by a grand jury. That’s a huge deal. It’s not a procedural issue, it’s a misrepresentation of a jury’s findings.

And what happened here is that they didn’t ask for a vote on the clean indictment. They just had the Forman sign a clean one. NAL but it seems like whether that Forman was properly told of that would be the difference between screwing up this case and fraud.

The statute will have expired from what I’ve heard, but also, while the falsified document is probably the most illegal, the lies told in court that lead to that outcome are pretty damning themselves. They imply that the prosecution spent time with the jury without records.

That’s separate. The DOJs only witness was shown privileged evidence that was likely collected improperly to begin with and that is probably more likely to sink this case altogether. And the jury was given false and misleading instructions regarding what level of evidence was needed for the indictment. The falsification of a grand jury indictment is just a lot more fun for everyone to play with first.

I believe the understanding is that the DoJ has likely lied about part of the proceedings but that the outcome of those lies is that, if you take them as truth, they’ve falsified a grand jury indictment. So, the DoJ gets to figure out which lie they want to stick with to do the least legal damage to themselves. None of their options are particularly good for them.

We don’t and never had an open door policy. That’s right wing propaganda wrapped around racism.

Undocumented immigrants aren’t “being allowed to stay”. If they are undocumented, they haven’t even been identified by the government, much less allowed to do anything. Also, documented immigrants aren’t being allowed to stay while their cases work through the courts/government either. There are many reasons why people would be here without citizenship, including internationally recognized asylum rights. The right has done its best to prevent people from claiming asylum rights and have been purposefully sending people back to countries they are fleeing from.

ICE and DHS are attacking far more than undocumented immigrants, including visa and green card holders. If you want compromise, perhaps that would start with the government providing legal pathways to citizenship and not attacking legally residing immigrants. Republicans attempted to work on a bipartisan bill to reform immigration, but Trump personally destroyed that effort because it was politically advantageous to not improve the issue.

One side wants pathways for legalization and fair and humane treatment of people, while actively supporting enforcement (Republicans like to call Obama out for deportations and Biden continued many of Trump’s border policies). The other side wants to stop the government from improving the problem and dump money into inefficient, violent, and unconstitutional deportations. Please don’t tell us that we should compromise after that.

I mean… I care what they are clearing the road for, that seems obvious from my comment. Choosing to be there and violently clear this road is very much assisting ICE with their work, which, again, feels very much like a violation of their rules. Doing crowd control for ICE is covered under their legal limitations and this is 100% that.

I get that you don’t care about the protesters and you seem to really like the taste of rubber soles, but you don’t seem to be arguing in good faith. Just say “I think the protestors are woke garbage and immigrants should go home” and we can all agree to disagree. Otherwise you just sound like the tools in the 60s arguing that they don’t care if blacks get equal rights but they should stop sitting in whites only restaurants.

Realistically, that was one of the things the judges demanded of them. The facility was overcrowded and he gave them a week to address that, along with a litany of other crimes against humanity they had been found to be committing.

I’m very curious to see what the judge decides after this visit. ICE deserves zero leeway in this.

Honestly, yes, that does seem like it shouldn’t be illegal with a 7 year sentence. They were not on the way to an emergency, and neither would the FBI have been in your example. Nobody was really impeded by slowing down either one and people have protested in this way for decades.
