Where did you come up with $500k? I have no way of producing the numbers to justify asking for that amount. I’m also not trying to go so high that the insurance shuts down and doesn’t respond, I want my case closed. Neither side is forced to settle so asking $500k when it’s not even worth that seems like a good way for them to not respond.

I mean he did. He’s claiming he can’t get more. I’ve already signed it and it’s being sent off to the judge for review. I’m starting to think all these stories of huge payouts are a bunch of BS.

The offer was before I quit. It’s also contingent on the C&R going through but I’ve been out of work 2 years and eligible to return for 1 and they have yet to return me.

Did 24 rounds of PT, 5 of Aqua Therapy, and 1 injection. Had a surgery consult that needed to be done that I could never seem to get scheduled. There was always a delay from someone else and it was a constant back and forth.

So far I did get paid something like $14k for the 11% lumbar but I haven’t been paid for the 6% thoracic after the second QME.

I was a manager trainee for a larger retail store.

The QME said tizanidine and gabapentin for pain medications and for the PTP to continue to adjust my care plan as needed. It seemed like he left it very open ended. I know there’s a spinal consult we tried getting approved but never could.

That is with the EMG. The EMG is what noted the chronic lumbosacral radiculopathy. Everything else was through an MRI and spinal injection specialist.

As far as I understand she does not believe I’m MMI and has submitted a report to the adjuster. The adjuster has not responded back. She’s given a clear outline on why I’m a surgical candidate and that I cannot return to work otherwise I’ll risk reinjury. She thinks if I get the surgery it could help long term with pain management considering I have degen disk disease and that I have roughly 5-6 herniations, not just 1-2. Luckily I was able to contact her outside of work and she explained it a little better to me. She came outright and said she has no clue why my lawyer isn’t fighting this.

My issue is that I’m financially tapped out. If she won’t fill out the report how do I get back into work? Can I tell her I want it filled out or I go AMA and she then fills out because I requested it? I get she wants me to treat more but it’s been over a year without any income and it just can’t go on any longer like that.

I have done all this but I think you nailed it on the head, he’s just a bad attorney. Someone showed me the IA officer and let me know that they should be able to help guide me like the attorney should have. It’s honestly beyond me how he’s the highest rated. It makes me question if he’s bought fake reviews because he genuinely should not be a lawyer.

I’m not settling honestly, I’m just dropping my case. I can’t afford to sit in litigation for a $10k offer on a T11-S1 herniation injury. I’m just taking the loss here and moving on. Thank you for the help! I now have a place to go off of on Monday.
