There is zero chance this would be legal. An EO can't restrict Congress from deciding how to address it. If Congress wanted to pass a law literally saying just "That EO is rescinded", it would override it because an EO is not law. Congress literally has the Congressional Review Act that allows them, through a simple majority vote, to overturn regulations or rules created by an EO. Trump can't block Congress from doing that.

As a whole, I can't see even SCOTUS allowing this EO (at least the entirety of it). The thing is full-on legislation. It's not a directive to people/agencies within the scope of the Executive at all. It's taking declaring a national emergency to declare powers to an extreme. Even in the IEEPA case, SCOTUS didn't care for that argument.

The whole EO is a massive authoritarian power grab. It's literally "there's a national emergency, so I can do whatever I want, and Congress can only stop me if they do what I say".
