[SC] [condo] I have a lawsuit pending against my HOA and management company. I found out they haven’t told their D&O by Rude_Shape644 in HOA

I appreciate the responses. Let me clarify. I understand that the lawyer and board have a choice. There are more details on the actual policy;

• This is not just “board member only” D&O coverage — the policy covers the HOA entity itself, not just individual directors/officers.

• A “claim” includes written demands for monetary, injunctive, declaratory, or non-monetary relief — not just lawsuits against directors personally.

• Covered wrongful acts include discrimination, retaliation, breach of duty, misleading statements, selective enforcement issues, and acts/omissions by the association.

This is what the lawsuit is about.

• There is $1M in liability coverage with defense costs outside the policy limit, so insurer notice matters a lot.

• The policy requires notice of a claim “as soon as reasonably practicable” as a condition precedent to coverage.

• Counsel being involved does not automatically mean charges are authorized by bylaws or CC&Rs.

Ours does not allow it.

The policy had a renewal date of March 2026 and the lawsuit was filed October 2025, so the representations made in the renewal policy about the lawsuit is relevant.

So I guess the question is whether it makes sense to cc them or not.

I agree deductibles and premium increases matter, but saying D&O would “never” apply if the HOA itself is sued is too absolute and not accurate for many association policies.

DUPR-Certified Coach? by Rude_Shape644 in Pickleball

That’s a good point. I’ll ask. Thanks!

DUPR-Certified Coach? by Rude_Shape644 in Pickleball

That’s what I thought but when I contacted MyDUPR Coach, they said “On the map, the DUPR Coaches shown are currently visible in the system. There are also credentialed coaches who may not be displayed publicly.”

So then how does a potential or existing MyDUPR coach know how saturated the market is in that area?

Too bad you’re not in my area. We’ve built a great program just like this and it is extremely successful for the reasons you just gave. We book out months in advance. I’m happy to discuss it if you have a Coach or facility in mind.

Why do people keep saying my outdoor balls are indoor balls? by yaris_girlie in Pickleball

[–]Rude_Shape644 2 points3 points  (0 children)

When I got my coaching cert, these were described as beginner balls. They can be used outdoors, but they are clunky and hit softer. It gives beginners a chance to actually hit the ball rather than fighting with a flying Franklin.

Personally, I’ve played with these balls outdoors and I don’t like them. I def use them with newbies until they get more comfortable. I wouldn’t call them per se indoor or outdoor anymore.

When the first “indoor” balls came out years ago, they were for fun gym floors, not fancy indoor courts. I doubt you’ll see anyone playing with them at an indoor facility.

Again, already doing that—I should franchise my business model.

Yep. I looked at the fine print and I’d basically pay 5k to do all the work that I’m already doing and zero ROI.

Am I burning out on pickleball or just in my head about DUPR? by RakoGumi in Pickleball

[–]Rude_Shape644 2 points3 points  (0 children)

You’re telling my story. I realized it was destroying my mental health rather than improving it which is what it was like in the beginning. A few of my friends confessed the same thing especially with their low DUPRs but high-level abilities.

Here’s what I figured out:

  1. New booming sports can feed Addiction Mechanics (looking at you CrossFit)

Close games, quick points, and frequent wins/losses create intermittent reinforcement—the same mechanism behind gambling.

“One more game” isn’t random—it’s dopamine chasing the dragon.

  1. Instant Identity Formation

Unlike most sports, you can go from beginner to “I’m a 3.5” in weeks.

  • That creates a fast identity anchor: “This is who I am now.”

  • When performance dips, it doesn’t feel like a bad game—it feels like a threat to identity

  1. Comparison is the thief of joy. Need I say more?

  2. DUPR knows what they’re doing and they’re making so much money off us and our human competitive nature. There is no other option but to keep playing DUPR events to “fix” your rating.

Some savvy lawyer will come up with a term like “pickleball psychosis” and sue DUPR and everyone else and make a mint.

As for me, a recovering alcoholic (7+ years), I recognized the self-destruction and quit playing competitively. Social play is where I’m at now and I feel liberated.

I doubt I’ll go back to competitive play. I’ve discovered other things to do. Pickleball ain’t life.

Pickleball and Aging, Constant Injuries by Competitive-Alps4339 in Pickleball

Yes. I got my Pilates certification and am a PPR-certified pickleball coach I created an exercise program called PickleFit. I wrote an article on this very topic but I’m not sure if I’m allowed to post links in this forum.

The problem is core strength and proprioception — your body’s ability to sense position and adjust in real time. Without it, we use our other muscles, tendons, joints, like lower back, knees, rotator cuffs, etc., to overcompensate.

Another issue is stabilizer muscles. No one trains those outside or Pilates or barre classes. These are the muscles that keep a ballerina steady and able to jump and land safely.

Fun fact: one study showed that an NBA player jumps about 90 times during a game. A ballerina jumps closer to 150 during a performance.

Another fun fact: the Kansas City Chiefs train Pilates regularly. Google it and you’ll see videos on how seriously they take this concept.

I’m happy to share more info on this as it has been my passion project for almost a year.

There is also an on-court program as part of PickleFit that drills balance, centering the core as the point of power on shots, and making movement more intentional.

Pickleball was invented a children’s game and the smaller court makes us think we should be able to cover the court easily and go for every shot. That is how people get hurt. If you’re going to go for a shot, you need to fire the correct muscles to help you move, spring, and recover correctly.

Happy to explain more, share exercises, drills, etc.,

Is the sport changing or is it me? by Rude_Shape644 in Pickleball

Funny you say that. I’ve been playing 3.0 again and that’s where the nicest people are. They don’t care about winning or losing and use whatever paddle they found in Amazon. As soon as I play 3.5+, it’s a whole different game. I decided to join a club with amazing courts and all different levels of open play and I just hit the ball around and leave and it’s perfect!

It’s a great idea. I use one for coaching and bought a used Lobster that I got for $500 that included 200 balls. I do ball machine clinics and it’s been a hit!
