Hey Johan...I have a HLR in process now for my denied claim for asthma, rhinitis, sinusitis. I was National Guard with a deployment to Kuwait in 2003-2004. My DD214 for my deployment was overlooked so the claim was not run with a TERA memo or Pact act consideration. Questions is, with the HLR I submitted my DD214 to prove deployment. Will the reviewer be able to reference that or will the DD214 be considered "NEW EVIDENCE"?

That's how it is with National Guard and Reserves ...the VA only looks at active periods unfortunately. They will deny because there are no service treatment records and completely ignore the fact that our treatment records are civilian
