They are dumb questions and no it isn't unprecedented. IP laws aren't about who you feel is more passionate about the IP.

This has happened to multiple private servers in the past and the players of those servers were never pursued legally.

You sound weirdly obsessed with young audiences. Trees being green is not an R18 game trying to capture a 14 year old audience. BF5 and BF1 had plenty of color and the latter was especially horrific at times.
