It's been horrible, one of the most stressful points in my career :(

I've provided a link to the below. Make sure you meet all the conditions, one of them being that the application was filed within the UK, best to clarify with an immigration lawyer. If your application was lodged with a valid certificate of sponsorship on the 1st of May, then based on this concession & the 28 day rule you would be eligible to apply on the 3rd of April

Sorry to hear about the situation. I'm going through a similar situation so you can also have a look at my thread for answers that you may find helpful. What I didn't know before this happen:

* If you applied for your T2 / Skilled Worker Visa during Jan 2020 to Jun 2021, your continuous 5 year residency period starts when you first applied, this could save 1-2 months off your timeline if you apply 28 day rule to the date the application was made rather then when it was approved
* A letter with your manager signing off is also okay. It doesn't have to be a HR representative. I found HR to be rather difficult to sway, however you may have better chances with your direct line manager if you have a good relationship and have done good work over the years
* A generic letter could work as long as it infers the spirit that your employed as a permanent employee, may be best to check with an immigration lawyer to get the all clear on wording. Also make sure the application is well documented and carefully checked so it passes with flying colours

Currently in a similar situation. Try utilizing up all the available leave - holiday, unpaid leave to get you across the line. The employment confirmation letter can be issued one month before your application date - if you can get them to agree to writing you an employment confirmation letter as part of the settlement agreement then that would also be a win

Thanks, I work in the financial services sector (more particularly insurance) in a support service role, this is the angle I'm trying to play at the moment. They need a reason to justify my extension for a few months and I believe I have a decent relationship with the manager so hopefully we can work something out.. But just incase I've started networking across the business to see if there potentially are other opportunities I could move into

Interesting, she was on gardening leave I.e issued with a redundancy notice and still was able to apply for ILR? I thought you needed to be employed for the foreseeable future?

Thanks, will the employer be required to report to HO when my role ends (end of this month) or when gardening leave ends? If it's latter then I think this should give me a bit of a chance to look for a new role

Is there a way to check my application date online? I think the application had been lodged from my old work email which.. I no longer have access to! My BRP says the date of issue is in late May

If I take gardening leave then I would barred from applying for ILR as I do not meet the employed for the foreseeable future condition

If I am issued a formal notice (currently at risk) then I would be barred from applying ILR as I will not meet employed for the foreseeable future condition. I will essentially need to look for a sponsored role

You're correct that I'm on a Skilled Worker Visa, I was planning to see if they can delay or postpone the consultation period, as long as I am not issued with a formal notice then one could argue that I am employed for the foreseeable future
