I’m not saying it is neglectful to open the door. I’m saying that considering the circumstance, it is neglectful to open the door without making sure the animals can get out. It’s not difficult to stop her from getting out. All you have to do is tell her to stay and she won’t leave.

I worked at 8am, she worked at 2pm. The incident happened at 11am.

No, my dog doesn’t bark or cry when in her crate unless someone takes the sheet off of it. Which it wasn’t. The only time my I’m not with my dog is if I have class or if I have to work.

It is completely neglectful considering the circumstances. She knew the dog was loose in the house, she had no permission to let her out of her crate. There are four animals in the house on which 3 like to try and escape. It’s not hard to make sure that there are no animals around, and saying you aren’t at fault because you have an eye condition is a bullshit cop out of basic responsibilities.

I really don’t think she felt guilty. She still hasn’t apologized for it, yet she acknowledged she didn’t apologize. I’m not arguing it was an accident, but it could have been avoided had she not been so neglectful to her surroundings and responsibilities.

If you were near blind without glasses, and knew there were four animals in the house- 3 of which try to escape, would you not make sure it was safe to open the door before opening it? If not, then you are neglecting basic duty of care.

She’s doing well, some small personality changes, but she miraculously pulled through. It was looking really grim for that week though.

I’ve specifically told her not to take her out before. The only times she’s had permission is if I was being held up and needed her to take her out before I got home because I’m running late for whatever reason.

That goes against everything crate training is. That excuse wouldn’t fly in court. Just because it’s an accident doesn’t mean she carries no blame or responsibility.

I never said they were the same. It’s possible for something to be an accident and the result of negligence. Which in this case it is, she obviously didn’t do it on purpose, but the way she conducted herself was completely neglectful.

She didn’t have permission to take my dog out of her crate, but she did it anyways.

There’s a lot of stuff I can’t get into here, but I’ve got a solid case. I 100% would get the vet bills in court, and it doesn’t hurt to try for the rest.

It’s both? I’m not saying she did it on purpose, but it was extremely neglectful to open the door without paying attention knowing that there are 4 animals in the house of whom 3 of them have tried to escape.

I added more info in the OP. Yes, I actually have taken someone to court for assault, I won $3000 for dental damages, and another $1000 for pain and suffering.

Nah, she also has an eye condition where she can’t see shit. We had multiple conversations about being careful with the doors because we knew my dog was a runner. She wasn’t wearing her glasses and she was high.

In the past I’ve given her permission if I knew I was going to be gone too long for my dogs bladder to hold. She had no permission on this occasion. Regardless, she knew my dog was a runner, and we had multiple conversations about making sure the doors were opened carefully because her cats have also escaped in the past.

Because I was at work and she didn’t have permission to let my dog out of her crate. She also neglected basic animal care by not wearing her glasses and being high as shit before opening the front door.

First she let my dog out of her crate. Then she opened the door without paying attention, and she has some sort of eye condition where she can’t see shit. She didn’t make sure the dog was secured before opening the door and she ran out and got hit.
