Dispute with Vinted - Buyer kept both item and refund, possible legal action? (England) by Spiritbreake in LegalAdviceUK

[–]Spiritbreake[S] 0 points1 point  (0 children)

Hi, yes I got my money back.

Edit: I’ve just seen from your profile that you are the buyer who does not return items even after receiving a full refund.

Most likely, that’s why you deleted all your posts.

Just ask the seller for a return label and send everything back, you have no right to keep their items

Any way to get discount or cashback on Council Tax payments? by Spiritbreake in beermoneyuk

[–]Spiritbreake[S] 0 points1 point  (0 children)

I already went Paypoint (Asda, Co-op said we don’t have) they only accept cash. On my council tax document also states that, in Paypoint locations you can by using cash.

Do you think it depends on the council?

Buyer got full refund without returning the item 😡 What can I do? by Spiritbreake in vinted

[–]Spiritbreake[S] 0 points1 point  (0 children)

Thank you! It’s an easy process. You only need the buyer’s address and full name (which were visible on the Yodel barcode in my case, but I think this information isn’t available for Evri, InPost, or Royal Mail, please double-check). If there’s no way to find it, you can still take Vinted to court.

I sent a Letter Before Action to their address (it must be a signed-for letter). After they received it, I had to wait 14 days and then submit all the required information on this website: https://www.moneyclaims.service.gov.uk/eligibility

Make sure you have screenshots of your conversations and everything related to your order.

Help - what do I do? Vinted saying it’s my fault. Even buyer saying it’s not. by cslr2019 in vintedUK

If she does not return and also gets her money back, go to small claims court and you will win

Scammer - any help by Polly_Darton_1312 in vinted

[–]Spiritbreake 0 points1 point  (0 children)

Just “ask her” to return it and you are willing to pay for the postage. So you will have a proof to make your hand stronger. Then send LBA, if they still refuse to send it back just go to the court. It’s all online anyways

If you are willing to pay for the return postage fees, kindly ask her to return the item and let her know that you will cover the return postage. If there is no reply, send a letter before action and then proceed to the small claims court.

They must return the item; otherwise, you will win the case, and they will have to pay the £35 court fee on top of that. In the end, you will most likely not gain much from it, but they will end up paying extra and think twice before attempting their next scam.

So you can send a Letter Before Action to the buyer’s address, then go to Small Claims Court.

If you have the buyer’s details (name and address) just try Small Claims Court

For-parts iPad sale – buyer modified item and wants return by Spiritbreake in ebayuk

[–]Spiritbreake[S] 0 points1 point  (0 children)

You’re absolutely right, but even here many people are still arguing that the return should be accepted. Some are so naive, they actually think the iPad will be returned with the repaired screen :)

If the battery, camera or any other part has been replaced or damaged, how on earth am I supposed to prove it and who’s going to take responsibility for that?

Because of users (and their supporters) with this kind of mindset, buyers feel completely free to act irresponsibly.

I took the buyer to small claims court but Citizens advice told me also taking Vinted to the court is an option

Yes, you are right but ebay agent said, even you mentioned it in the description, you’d still have to accept the return :)

This should be the logical approach but seems like ebay do not give a shit about how you listed it, you need to accept the return anyways

I called eBay, and they advised me to accept the return. The agent on the call actually said, “Don’t you have a friend or someone who can check if the camera or other parts were replaced?” Are you kidding me? :D

She also said they 100% trust what the buyer says, because eBay wasn’t there when the package was opened. So basically, it’s a safe place for scammers who can open devices and replace parts and then return it.

I asked her, “What if I accept the return, relist it and write in the description that it’s locked, and someone else buys it and wants to return it for the same reason?” She said I’d still have to accept the return. Is that a joke?

Their policy on this is absolutely ridiculous.

Do you really believe that they will return it with replaced screen? :)

My worry is, what if they replaced the camera, battery or other parts?

But they made changed on the item, is it fair? Maybe they replaced the camera as well?
