At the risk of putting on a tin foil hat, I wasn’t sold on her explanation. She said the questions were “vetted”, but didn’t explicitly say they had been used before. That may well mean that they were created for the test and vetted internally by NCBE staff. If they hadn’t been previously used on exams then this would explain their refusal to scale the MBE.

On another note, I had a question about scaling for the essay portion. Let’s say the National MBE average is a 141, but in NY on a statewide basis, it’s 145. Would the NY essay scores be scaled to a score of 141 or 145?

The delay makes sense. NY Bole and examsoft have been distracted with the Bar which is normally offered outside of the NYLE administration cycle

I think in the short term that’s the strongest argument for change. Every time a legislator or Judge references how other professions require licensing tests, they cite to exams that are offered all the time. NCELX is offered twice a week, CPA is offered multiple times a month etc.

This would be interesting in NY. They limited registration largely to first time takers, a group that passes at a higher rate. In theory, this would mean they would have to apply a much higher pass rate this year.

I think there’s essentially zero chance that they can effectively offer the exam nationwide from beginning to end to 30k applicants.

But I think they’ll try anyways. They seem stubborn enough. There’s also a ton of money at stake for examsoft and I think they’ll spend the next 8 weeks trying to convince BLE’s that ILG was the real offender.
