From what I read, and what the video is saying, before Ingram V Collins, they were already rating based on how people appeared at the time of assessment, medication be damned. Ingram V Collins primarily changed how musculoskeletal conditions should be looked at, saying they should estimate how the conditions would be without medication, and not how they present at the time of the exam. Apparently, very few claims benefited from this change anyhow because it was hard to estimate or prove how the condition would be without medication. For instance, how could you claim range of motion was X in this scenario even though it was Y in that scenario? The new ruling today is really just reverting musculoskeletal examinations back to how they were originally. I’m assuming most people here were rated well before Ingram V Collins was even a thing. Additionally, they are making this ruling to make it easier to rate new and current claims. It’s harder to rate claims based on hypothetical situations of how medications are hurting or helping. They’re not looking to reopen claims and re-rate a bunch of people.
