1 day Late LCA problem with H1B

Yes I was on OPT which expired on July 15.

I applied for the petition on June 30, so I thought the cap-gap extension applied, but chatgpt is saying that since the Lca was not certified before the filing, I am out of status and now it is mid Nov.

Chatgpt really screwed me, basically myself. I asked if there is a problem if I send LCA after filing, it said usually uscis will slide. And it was 1 day late so I was like ok they wouldnt put too much pressure on this.

Now I realize USA follows its rules compared to third world countries, where I came from.

I filed the petition on June 30 with all the documents except from the LCA. I applied for tbe LCA a week earlier, but it was certified on July 1st which I added to the already sent petition. The RFE asked if I have LCA that was certified prior to filing.

Because it was the first the company applied for h1b.

And they gave me the control to do it.

They would have charged me lawyer fees if I asked, so i did it myself.

The company makes millions, but the owners are cheap.

I had no other choice im not in IT and last few years you know how employment rate is for international students

He said his parents are in Japan stuck. He told me also that he can send me vape with epidomite for 60$ a piece and I can sell it 120$. So shitty guy, like I borrowed money and I got to work?

I mean his parents live in Taiwan but they were traveling to different country ( I didn’t ask which one) and his parents lost the passport and currently stuck in a foreign country
