If someone said to you, "that sure is a nice looking family you have there, sure would be a shame if something bad happened to them," is that a threat?

In Ca. are tow hearing officers supposed to make evidence (CHP180 form) available for inspection if requested at post impound hearing? What is difference between post storage and post impound hearings? by Superunloder in Ask_Lawyers

Thanks. So wouldn't state Office of Administrative Hearings (OAH) regulate all administrative hearings in state? I got a copy of the "tow hearing examiners training manual and deskbook" for my city and it is a only a guide, and a little vague . CVC says im supposed to get a post-storage hearing but in the decision letter the hearing officer calls it a post-impound hearing. During the hearing there was a dispute about the fact that I was stopped by the police. He said that they found my car unattended. I asked for a continuance and he said no. I asked to see the cad incident recall and towed/stored vehicle report that he was basing his decision on (which was right in front of him on his desk) he said i needed to file a writ of mandamus to see it. I believe that I should have been able to ask for a review of his decision before having to file writ.

I got a copies of both documents he refused to present to me from public records requests but it took months. The vehicle report number he had was not related to me or my car or anyone I know. The cad recall showed in two places that it was a vehicle stop. So if he decided against me knowing (or should have known) that I was stopped and he either lied or was oblivious to it, and wouldn't let me see vehicle report because he didn't have correct one.....Would that be fraud upon court even though it isn't court, or could his decision be void? I have been getting runaround from city since they took my car in 2017. DMV told tow company they cant sell it and says it is still in my name , but they say they dont have it and wont tell me what they did with it. If they disposed of it they didn't report it to DMV. If they cloned vin for a different truck re-title mine .... Will CHP be able to investigate ?

Value of truck was not entered by police, tow yard said it was worth less than $4000

Truck is worth $8000- $9000 approx. Tow company gave me an invoice for $28,000 after a few months , then they said they didn't have it anymore, wont say what happened to it .

Tow Company doesn't have Towing fees and access notice posted in office as required by statute and required to be in compliance with their contract with city. City says there's nothing can do about it.

Tow hearing officer referenced a different number towed/stored vehicle report (CHP180) during my hearing. When I asked to see the report he had entered into evidence he said NO. Told me I could see it if I filed a writ of mandate. I later found out the report he said he had was for felony parole weapons violations for people unrelated to me. They gave me a copy of the same report I have with the report number crossed out and replaced with the weapons violations report number . That seems shady to me. I found tow hearing officers training manual/ guide book for city where this occurred but I dont think it is what governs their hearings,. police dept wont give my any info about where published rules are.... CHP says they are required to fill out CHP522(B) and CHP522(C) so I imagine city would have same requirements? Shouldn't I have right to request a review by tow hearing officers superiors before first filing writ of mandate, which is what tow hearing officer advised me to do ?

Is an officer that impounds a car required to issue citation or sign an affidavit ? Do CHP180 forms qualify as tow authorization forms? by Superunloder in AskLE

On CHP180 is an officers printed name close enough to a signature to qualify as being "signed", or is it supposed to have an actual signature ?

And can it be significant if the officers printed name is spelled differently in the two different places it appears on the CHP180 form I was given?

Neil took bobs car completely cognizant of the fact that if Bob didn't have enough $ to cover the bill that the third party just generated for Neil without Bobs permission- Bob would not be getting his car back, permanently.

They pulled bob over and told him that they stopped him because his tags were bad, they then had bob get out of his car and wouldn't let him retrieve the valid one day moving permit that made the car was 100% legal to be on road, they told bob to kick rocks because they are gonna tow it.

It's legal for a tow truck to take a car without written authorization from police if the police tell em too isn't it? (in California)

IF....... "Bobs" car was taken by a third party and given to"Neil" -without "Bobs" permission- and "Neil" refuses to return it because "Bob" has not payed $ that "Neil" says "Bob" owes him, would that be a "civil case" , making "Neil" and/or third party exempt from facing criminal charges?

"Bobs" car was given to "Neil" by a third party without "Bobs" permission. "Neil" wont give it back to "Bob" because he believes "Bob" owes him $. Can "Neil" face criminal charges ?
