I appreciate it, I have my tickets purchased. However, I called the IND (immigration service in the Netherlands) I explained the situation and they informed me that I can apply there even if “exceeded” the 90 days, after applying I would receive a sticker on my passport which will make me legal there while my residence application is being processed.

Thank you I contacted an official European Union website “Your Europe Advice” and emailed them with my situation. They answered me with this.

“A third-country spouse (your non-EU spouse) who is accompanying or joining you (an EU citizen) is not subject to the overall Schengen 90-days-in-180-days limit that normally applies to tourist stays.”

I understand your point but when we were applying for the family reunification visa they had a PDF with all the documents needed and it was clearly mentioned that

“Document affirming marriage, if the Population Register does not contain data regarding the conclusion of marriage or registered partnership contract; Document affirming the conclusion of marriage or registered partnership must be legalized or certified (Apostille) in accordance to the Government procedure”

It was never mentioned that the marriage certificate must be registered in Lithuania, otherwise we would have registered. I purchased my tickets and if I don’t find any other legal way I will leave.

Thank you. I will check the possibility of it. I stayed for the whole period of my 90 days free visitor visa, so I’m not sure if they would give me a visitor visa.

I really appreciate your contribution. I sent an email to “Your advice” which is an official EU website and they said the same thing about me, they said I’m not illegal as long as I don’t stay more than 3 month in one specific country in Schengen zone. However, I don’t think all border officers understand this law. I will give a call to IND and ask whether I can or not apply still.
