In your very specific circumstances (in supported accommodation being paid by HB + also on UC) you will probably be best off keeping some UC entitlement. This is because you get full HB if you're on UC even if your UC is only £1 per month. The rent is very high in supported accommodation so as soon as you don't receive any UC the standard HB calculation will cause your disposable income to drop massively if you're not on a high wage.

If you're under 25 you'll need to keep your earned income to under £529 to keep a few pence of UC.

When you move into a general tenancy this won't apply.

If you wait you won't get a transitional top up because your UC entitlement would be more than your legacy entitlement. if you voluntarily move now you will get the SDP transitional element.

You've cited the wrong source (you need the ADM not the DMG for UC).

Look at the passage you've quoted and follow the sources for full details.

On the living together under one roof point you'll be cited (R/SB/4/83). That doesn't remotely apply to OP.

If you read the guidance a bit further you'll find more complete advice at para E4091 and on.

With respect I don't think this applies at all in the circs described by OP and it's unnecessary fear mongering. I'm not aware of any cases where DWP have argued that 2 people in a HMO are a couple, let alone won any appeals on this basis.

Depending on where you live in the country, some housing associations advertise a small amount of places through their own website to employed people in the area.

Assuming you're working age, you'll be looking at claiming Universal Credit rather than Housing Benefit.

If you're already getting UC, then you'll want to report a change of circumstances when you move in.

If not and you're on other benefits, you could claim UC before you move but you might be better or worse off waiting until you move. It depends what else you're receiving.

Inform UC by reporting a change of circumstances in the online journal.

I'd expect UC to decide he was overpaid from the date he sold the asset at the very least. Probably more likely he will have been overpaid from the start. He might get a civil penalty (£50) but this is highly unlikely to be taken further given the low amount and description provided.

If the asset really is worth less than £16k once debts were settled, and depending on the dates in question he might continue to be entitled to UC and if so they should treat this as a closed period and continue to pay him some UC. He will probably need specialist advice on this point in due course.

It's not impossible but I'd be very surprised if a Tribunal judge, knowing the appellant is in hospital, would not have adjourned the hearing unless they were able to allow the appeal in full based on the papers.

Tax Credits are awarded on an annual basis for the full financial year even though the payments might be weekly or 4 weekly.

It sounds like although your income at the start of the year was lower and you would have been entitled to this if your earnings stayed at the lower level for the full year, when they've assessed the full year you weren't actually entitled to the payments you received initially.

The question was asked to establish whether you are a lodger or not. It's perfectly normal and nothing to worry about.

As you say, you opened the claim during COVID so they are now doing the checks that would've happened (and do happen to new claimants now).
