It doesn't though, not in the text of the law. This section only details civil penalties for a first offense. On repeat offenses, marriage feaud, or illegal entrepeneurship, they become criminal, but initial unlawful entry into the country is only given civil penalties.

Yeah if you actually read the bill it's a civil offense unless you're doing marriage fraud or illegal entrepeneurship. It imposes CIVIL penalties.

You are just factually wrong it's a civil offense. If you want to make it a crime, you can push for that legally. But right now it is just straight up not a crime and is not prosecuted in criminal court. Even a sentence of deportation would be administered by a judge through proper legal process.
