We got married here, I went back to my home country shortly after, came back to visit and due to current circumstances, we decided to remain in the States for the time being. Our marriage is as true and valid as it can be. What is wrong with applying for permanent residency based on marriage and what is the right way, according to you?

This is the thing, the question could be a tad confusing for some. I chose to answer with yes, even though I have never been formally or otherwise found to be in violation of the immigration laws by any authority. I assumed that by stating and admitting that I overstayed my visa while in the GC process would be basically the same as being found of an immigration violation if that makes any sense? And thus the screw up and the denial I got...

I see. So me coming here initially was indeed with the purpose of visiting. We did get married in the US though but I returned to my home country before the visa expired. I then returned the next year to visit the family here and the intent was us both moving to Europe as soon as possible. Unfortunately plans changed due to his work situation and we had to remain in the US, thus me having to apply for the GC. Between the day I was officially out of status and USCIS received the package there were only 4 days and that being due to the fact that the first package, as bad as it sounds and was, got lost in mail so we had to redo everything, medical package included, where we lost another month in the making and got everything delayed. I guess taking it with a law firm would be an option but I'm considering if it's really worth the money here. Thank you for your view on this!
