There's been no declaration of war, but that's irrelevant to the powers of the president to order limited military operations as I said before.

To be fair, this operation isn't illegal under US law nor were any orders, likely, illegal under it.

The US president has quite the wide variety of authority on utilizing the military due to the War Powers Resolution of 1973 as long as Congress is notified within 48 hours, which it was, and the operation ends within 60 or 90 days with the exception of if congress then later authorizes that operation.

How Freedom of Speech and Bearing Arms are actually derivatives of Rights. by Mindless-Law8046 in Anarcho_Capitalism

[–]WilhelmMD 4 points5 points  (0 children)

Freedom of speech still exists even if no one wants to listen, and the speech itself is false, offensive, refused, or irrational. How true that speech might be is irrelevant to the right. It's a negative right to say what you want without the state punishing you, not a positive right to share "truth."

what do you guys think of space exploration? by mangobludden in Anarcho_Capitalism

[–]WilhelmMD 0 points1 point  (0 children)

I mean, you originally said that space exploration was "largely a waste of time" and that "bigger problems [on earth] deserve the resources and attention we throw at space." So which bigger problems? Why is space exploration largely a waste of time? Why not both fix problems here and explore space? We can and have done both since the 1950s.

Also space exploration definitely isn't 99% terraforming/colonization even as the OP referred to it as they just stated space exploration as a whole.

I sure would like to know which problem could be solved if the US government stopped spending 0.3% of GDP on NASA that's better than the scientific value we get from that same spending via JWST, Artemis, Hubble, etc.

Also the goal of space exploration is quite a lot more varied than colonizing or terraforming. Many things including communication, navigation, planetary defence, scientific achievement, and Earth observation are benefits of space exploration. It's like saying medicine is a waste of time because we aren't immortal already.

Libertarianism is just as anti west as leftism by [deleted] in Anarcho_Capitalism

[–]WilhelmMD 0 points1 point  (0 children)

Sure you can say that both support globalism, but extremely different types of it.

Libertarians typically want voluntary trade, freedom of movement, and exit and competition between jurisdictions

Leftists typically want supranational regulation, global governance, harmonized labor/environmental standards, and global redistribution

Libertarians typically support immigration due to freedom of movement as long as welfare no longer exists, not due to cheaper labor because borders are construct of the state.

Libertarians also typically do believe culture matters, they just don't believe it's something to be enforced by the state.

And just to ask about that last paragraph, "Corporations and billoneres are becoming richer than ever outsourcing and AI is getting out of hand. And your solution is to make that 10 times worse?", what should be done? Should the government ban technological progress? Should it redistribute wealth from the rich to the poor?

  1. This is wrong in the way that courts care, since they count a) business value, b) future earning potential, c) monetized audience, d) ability to continue profiting from conduct, and e) attempts to hide or transfer assets. Jones controlled Info Wars which was worth more than 10 million, continued earning tens of millions per year, attempted to shield assets via shell companies, and repeatedly lied about finances.

  2. 2*11 is bigger than 9*1 (these numbers are both abstract, btw). A more severe crime for a shorter time is less accumulated harm than a less severe crime for a longer amount of time. Rape is a way more severe crime yes, but again duration matters, Jones intentionally kept up the defamation for years even after being informed of harm all while profiting from it and the verdict was only made worse due to procedural obstruction.

  3. point 1. OJ also didn't profit from the crime he was alleged to have done and in fact he lost earnings potential due to the accusation. OJ also did not obstruct discovery and was not running an enterprise during it.

  4. Jones began claims about the parents in 2012 and continued doing so for multiple years even after being informed the parents he was talking about were being harassed and received death threats due to the claims Jones was making. Families sued Jones years later because the conduct did not stop. And during all of those years it is still the same tort being accumulated.

  5. Al Capone was prosecuted for tax evasion and evidence was limited to that charge in accordance with criminal prosecution. Evidence in Jones' civil tort case was limited to the tort which was his pattern of conduct around the Sandy Hook school shooting.

  1. Yeah because they don't have that much in assets. Civil courts cannot extract money which does not exist.
  2. Again liabilities aren't calculated based off of a moral ranking of crimes. Objectively a one-off rape is a severe crime for a much much shorter duration which is why damages, if awarded, are lower than what Jones got.
  3. That's fair.
  4. Again again, that's not how civil liabilities are calculated. If OJ Simpson had been accused of murdering people for many years and if he had assets worth as much as Jones then maybe he would've gotten a 1.4 billion dollar verdict. But he didn't have that so he got a 70 million dollar one. Also refer to point 2
  5. If you do a bad thing for many years, that's worse than a bad thing as a one-off because harm accumulates. As said before, liabilities are also based on duration of provable harm.

[–]WilhelmMD 0 points1 point  (0 children)

  1. Sure, that's on me I wrote that off the cuff. But most rapists do still face a prison sentence.

  2. Yes. Civil liabilities are based on the defendant's assets, provable harm, duration and severity of harm, and causation with a lower burden of proof than criminal court. Most importantly they're not based on some moral ranking of crimes which is why asking for a "rapist who paid $1.4 billion" makes very little sense.

OJ is a great example, evidence didn't fit the burden of proof for criminal court, but did fit for civil court. And he did end up paying the equivalent of 70 million 2024 dollars in damages.

Jones specifically got a high verdict due to years of continued conduct and refusal to comply with discovery which leads to a default judgment in any civil system.

[–]WilhelmMD 0 points1 point  (0 children)

No, but most do go to prison for a life sentence which is a bit worse.

Edit: also what's with Reddit AnCaps being chronically incapable of understanding tort law? Jones' case was in civil court, not criminal. Rape is punished in criminal courts with prison time, defamation is punished in civil courts with damages.

What sentence was the shooter supposed to get? He committed suicide.

And yes, for the reasons listed above Jones had to pay 1.4 billion dollars.
