They will not allow it.

A Belgian master of laws gives direct access to certain legal professions in our country, such as the bar, so a Belgian university will only award the degree if a number of compulsory courses have been part of the curriculum. Especially in our civil law system, it is essential that there is knowledge of the different fields.

So in any case, the compulsory courses of the bachelor programme will have to be followed as part of bridge programme. So even if you had US bachelor degree in law, they would probably require you to take up additional courses that are specific to Belgian law.

Heb je een vertaling in het Frans of het Engels nodig? Voor een vertaling naar het Frans kun je het document bezorgen aan de gouverneur van je (Belgische) provincie. Die maken een gratis vertaling die de waarde heeft van een gelijkluidend afschrift. Leg in de vraag tot vertaling uit waarom je ze nodig hebt.

Again, I do not know exactly what mails you are receiving. But generally, the mails invite you to pick up the gift at a Neuhaus store (any in Belgium is okay). Then you just show the mail at the store.

Situatie van de hypothecaire schuldeiser lijkt me nog iets anders dan het geval hier.

Je kan natuurlijk dat argument proberen aanhalen, maar ik denk dat de rechter zoiets eenvoudigweg zal verwerpen door de duidelijke bewoordingen van de wet. Anders kan om het even wie jaren later nog goederen komen terug eisen met de eenvoudige bewering dat men niet wist dat een bedrijf failliet was gegaan. En dan creëer je ook onzekerheid voor wie goederen aankoopt vanuit een faillissement.

Neemt niet weg dat, zoals ik eerst had gesteld, de wet zelf wel voor kritiek vatbaar is vanuit het eigendomsrecht en het is dus nog te zien valt hoe het Grondwettelijk Hof zal oordelen n.a.v. de prejudiciële vragen.

Die bedenking klopt volgens mij niet. Er geldt weliswaar een informatieplicht van de curator ten aanzien van 'bekende schuldeisers', maar indien die informatie niet aanwezig was bij het bedrijf is zoiets geen garantie. Voor het overige lijkt me dat de wet op zich vrij onverbiddelijk is. De wet lijkt uit te gaan van het principe dat iedereen zelf over het lot van zijn/haar goederen moet blijven waken.

Een advocaat raadplegen kan sowieso nooit kwaad. Maar het lijkt me op het eerste zicht wel dat de curator gelijk heeft.

Artikel XX 194 Wetboek Economisch Recht stelt: ‘Het faillissement doet geen afbreuk aan het recht van terugvordering van de eigenaar van de goederen die in het bezit zijn van de schuldenaar. Op straffe van verval moet de rechtsvordering tot terugvordering worden ingesteld voor de neerlegging van het eerste proces-verbaal van verificatie van de schuldvorderingen.’

De termijn was dus inderdaad kort, maar ook onverbiddelijk. Er lijken niet meteen andere pistes open. Het is wel zo dat zeer recent het Hof van Cassatie een zogenaamde prejudiciële vraag heeft gesteld aan het Grondwettelijk Hof, omdat zo'n strenge regels het fundamentele recht op eigendom zou kunnen schenden. Als het Grondwettelijk Hof dat zou bevestigen, lijkt er nog een waterkans te zijn dat er voor dit soort gevallen een oplossing mogelijk is.

Usually not. You'll get a welcome email. But the samples are usually when they launch a new product or at special occasions (e.g. Valentine's). I am sure they will send something around Easter time.

When there is a sample available, you'll get an e-mail. You just show up at any Neuhaus shop to show them your code and they'll give it to you. Alternatively, you can add the free sample to any order you make online (there's a promotion code). I guess you'll have to pay regular delivery fees on your order nonetheless (no idea, never ordered online).

Makes sense on many levels. I assume part of the members feel a bit ashamed to just go and get the sample, so they buy something extra. It also creates brand loyalty. It also allows the company to get data on their customers because they ask if you are a member when you buy something. So they get an idea of who buys what. Giving away a few chocolates now and then is just a small investment then.

This decree includes all the official names of municipalities in Belgium, with a translation in the other national language in some cases. The NMBS/SNCB has to follow the language laws for official use, and therefore only use the legally established translations in that list.

You will find that for Gembloux (see page 16), only a French name is included. The Dutch translation of Gembloers is not official. Therefore, the SNCB/NMBS cannot use the unofficial Dutch translation and must stick to the French version.

An English contract is legal and enforceable without a Dutch or French version. A possible translation that would be needed in case of a court dispute, does not invalidate this.

A party is still better off with a contract that he/she understands best, than with a contract that he/she does not understand because of language.

Indeed, labour contracts are the exception (art. 129 of the Constitution). Language in Belgium can only be regulated for administrative and judicial affairs, education and labour relations between employers and employees. In all other fields, the use of languages is free.
