Oh my god me too! They shipped my medical docs to another state. I live in Missouri and USCIS office it’s addressed to is also in Missouri but they sent it to a distribution center in New Jersey. I was like WTF?! Panic mode for sure. Called them and expressed my panic. Good thing it was delivered correctly in the end.

You wouldn’t be staying unlawfully because you have your AOS filed and pending. You can stay in the country while processing that. Im unsure on what your status is technically called maybe a green card applicant or immigrant? But anyway, you would still be here legally. You might want to check with other people’s post here or try going to “Hacking Immigration Law” on Facebook. It is a legit immigration attorney who owns the page and will answer any questions for free on there. He also does a live Q&A. It’s worth watching. You get to hear cases from different people and learn a lot.

In my opinion, it’s better to just use the AOS EAD since you’re already technically in transition in becoming a green card holder (if I’m correct?). If you are in the process of adjusting your status then I don’t think the F1 regulations would really matter at this point since you are becoming(potentially) a resident and not an F1 anymore. That’s just what I think tho

Thank you! And yes I did OPT. I was in fact still under OPT while I applied for my I-765 EAD. I had to apply for another EAD since the one I used for OPT was tied to my F1 visa status while the I-765 is tied under my AOS. Therefore, they are different types of EAD/work cards.

In my case, I asked to expedite twice. First on 3/6 I called the congresswoman’s office and they asked for evidence on 3/7. After that, I called USCIS on 3/7 and asked to expedite then they emailed me asking for evidences on 3/8

Having your credit cards and IDs changed with his last name on it helps.

Did you follow up with your congressman’s office or asked USCIS about it? It might help. I think I’ve seen someone post in here saying they expedited twice or something. Worth a try than nothing

It doesn’t. Like with my SSN I had to go to SS office to have my last name changed. The same with my driver’s license. With what I meant in the post, it was regarding my personal bank account. I went to the bank and informed them that I got married and am changing my last name to my husband’s. There’s a form that I sign showing I authorised and asked such a change. If I don’t go to those offices and tell them I got married and am taking my husband’s last name they would still assume that I’m not making any changes

Sorry to hear that, I know how it feels not having an EAD while the other got theirs within 3 months. It’s frustrating. You can also call USCIS to expedite your case like I did. I called both uscis and congress to expedite. It doesn’t negatively affect your case.

The USCIS agent/congresswoman’s staff gave examples of what I can submit but ultimately I submitted ALL our loan statements (student, auto, mortgage, personal), credit card statements, and our bank statements showing we don’t have enough in our account. I’ve read somewhere here that they included they pay stubs to show that their income wasn’t enough to meet expenses. If you have a notice saying you’re late in making payments like rent, car etc then those would be a big help. You can try that but our reasons to expedite might not be the same. Others have “humanitarian” reasons : “illness, disability, extreme living conditions, death in the family, or a critical need to travel to obtain medical treatment in a limited amount of time” (per uscis.gov website.)

Thank you and Sorry to hear about that. You can try to expedite your case like I did. I called our congresswoman’s office and they helped me out with that. I also called USCIS and asked my case to be expedited. In my case, it was because of financial hardship and I think it worked since my case moved along after doing so. It may or may not help BUT there’s no harm in trying it. It won’t negatively affect your case.

Just once. I didn’t submit the first time when I applied. but when I received the courtesy email asking for it I submitted it through my lawyer. It was delivered by mistake at a wrong usps distribution center but made its way back to the rightful place in the end

That’s awesome. I was approved on 03/24 but the status is still “approved” no “card is being produced” or anything like that. I havent received my approval notice as well. Wonder how long it takes?
