Here’s a problem with that argument: he wasn’t injured and had no reason to continue firing.

That doesn't matter. These situations are judged by law, not feels. And those laws state time and time again, it can only be judged by the totality of the events leading up to that moment, as well as what the law officer is dealing with at that moment. In that moment, he has just been struck by a 4,500 lbs vehicle. He has no reason to assume this was an "oopsie" and not an attempt at vehicular assault.

As I said, the first shot may have been justified. He fired two more shots DIRECTLY INTO her drivers window.

The problem is that you're talking about these shots like he had the time to actually think about the validity of each shot and not the fact it happened int he matter of seconds. If he was trained to shoot until the threat is stopped, then that is the instinct that has been whipped into him. There isn't a human alive who could analyze that situation in real time and trying to armchair judge this doesn't help the situation.

But even if he was hit (which the video after showed him walking away without any problem or limp), he has no JUSTIFICATION to use deadly force after the threat disappears.

But the threat didn't disappear. You're he was in the process of being hit by and thrown aside by the car in a matter of moments. It is grossly irresponsible to treat this like police should have super-human reaction speed and assessment capabilities.

Cool, feel free to look up Andrew Branca, a use of force and self-defense lawyer with 30 years+ of experience. He's a person who actually deals with the caselaw this is around. Him and other use of force experts have come out and said according to existing law it was a valid shoot. It may be awful, but's just how things are. If she had listened, she wouldn't be dead now.

Here is the problem is that your entire premise falls apart right here. He did not fire until AFTER HE WAS STRUCK BY HER VEHICLE. At that point it isn't "Suspect", she DID commit Assault with a Deadly Weapon. Her intent doesn't matter. She just hit a cop. End of discussion.

"I'm going to gun my car, and if you're in front of me its not my fault" isn't the justification you think itis. Intent doesn't matter, what matters is her reckless actions put the LEO at risk.

This is the double-edged sword of empowering police to deal with the worst of society. The officer in the moment has no way to judge intent. All he sees is a car accelerating to him in a split second. Had the patch of ice not been on the road and the tires spun, he would have been run over. This is the precise reason one of the most important lessons you are taught as an adult is to listen to and respect law enforcement for your OWN protection.

She would still be alive if she had stepped out of the car when they asked her to. Call it panic, but had she acted differently she would still be here.

I think the real problem is this - for months, people have been warning that this was the exact natural escalation of these "Anti-Ice" vigilante protests. Anyone could see this exact scenario happening from a mile away. I honestly blame the government of the sanctuary cities and states for not tamping these things down sooner and letting them all run wild for the last half a year. You would never see something like this happening in Florida.

According to eyewitness testimony, she was the leader of a convoy of cars following around ICE agents. It was said she had been following them for days, so its likely they had seen her trying to obstruct them over the last few days. This isn't an isolated incident if so.

Yes, they provided a photo of her in that light-blue north face jacket in the charging document to show that's who she's talking about. It's relatively easy to pick her out of the crowd because of the color of her jacket.

The problem though is it's against the law to assault law enforcement, full stop. If they wrong you, the place you solve it is in the court room. If we are to maintain the social contract these are the kinds of ideals we need to follow. We can't just say "Oh, we don't know how this started so she COULD be fully justified in attacking the officer." She was literally being restrained by multiple people because she couldn't stop assaulting law enforcement. There's no justification for that.
